(a) the steps taken by the Government to implement the Seventh Pay Commission recommendations for physiotherapists regarding cadre restructuring till date;

(b) the duties and responsibilities of physiotherapists employed at Safdarjung hospital, RML hospital, Kalawati Saran hospital, JIPMER and AIIMS;

(c) whether the physiotherapists at the above hospitals are being given Hospital Patient Care Allowance (HPCA); and

(d) if so, the details thereof and if not, the reasons therefor?

(a) As per decision of the Government on the recommendations of the 7th CPC notified vide Resolution dated 25.07.2016, necessary action on the recommendations of the 7th CPC pertaining to cadre restructuring of physiotherapists have already been taken up for implementation in some of the Central Government hospitals/institution.

(b) The duties and responsibilities of physiotherapists performed in Safdarjung hospital, RML hospital, Kalawati Saran hospital, Jawaharlal Institute of Post Graduate Medical Education and Research (JIPMER), Puducherry and All India Institute of Medical Sciences (AIIMS), New Delhi and six other new AIIMS located at Patna, Jodhpur, Bhubaneswar, Rishikesh, Bhopal, and Raipur broadly include the following:
  1. physiotherapists works with patients who have a range of conditions including Neuro-musculoskeletal, Geriatric, Post-surgical, ICU Patients, Pediatric, Cardiovascular and respiratory. They help to diagnose, assess and treat their physical problems
  2. treat in and out patients of Orthopedic, Neurological, Medical Surgery, Pediatrics and Gynecological, cardio-thoracic, respiratory & intensive care condition by means of electrotherapy, heat therapy, hydrotherapy, exercise therapy and massage
  3. provide physiotherapy care including exercise, hot packs, wax bath, short-wave-diathermy, ultrasonic therapy, cervical & lumbar traction, gait training, electrical stimulation & bed-side physiotherapy in ward as prescribed by the medical specialist, etc.
  4. administer and supervise students and junior physiotherapists and other support workers, who are involved in physical care of patients.
  5. participation in rehabilitation of patients
  6. co-ordinate and participate in training programmes related to physiotherapist
(c) & (d) As per the guidelines issued from time to time for grant of Hospital Patient Care Allowance (HPCA), HPCA is admissible to employees belonging to categories of Group ‘C’ and ‘D’ (non-ministerial) whose regular duties involve continuous and routine contacts with patients infected with communicable diseases or those who have to routinely handle, as their primary duty, infected materials, instruments and equipment which can spread infection.

Hospital Patient Care Allowance (HPCA) is not being given to Physiotherapists in Safdarjung, Dr. RML, Lady Hardinge Medical College and Associated Hospitals and AIIMS, New Delhi and six new AIIMS located at different parts of the country as the physiotherapists working in these hospitals/institutes are Group ‘A’ and ‘B’ category employees. In Kalawati Saran Children Hospital, the physiotherapist are not getting HPCA as these employees are in the pay scale of Group ‘B’ category.

However, JIPMER, Puducherry continues to give Patient Care Allowance to physiotherapists as per the directions of Hon’ble Apex Court. These directions were issued consequent upon re-classification of Group ‘C’ category posts to Group ‘B’ posts based on the replacement scale as there was no change in the duties and responsibilities of the post held by the incumbents.

Sub: VII Central Pay Commission recommendations - Submission to the empowered Committee Secretaries- reg.

1. Bharat Pensioners Samaj(BPS) Federation of pensioners’ associations, a conglomerate of over 628 pensioners’ organizations as an accredited Federation under the Government of India, had appealed to the Secretary, Ministry of personnel, Public Grievances and Pensions, on 16.2.2016 during the meeting on Aadhar seeding to hold a meeting of Pensioners Associations to discuss 7th CPS pension related recommendations, though he had agreed to hold such a meeting but it did not materialize.

2. Now BPS has come to know through NJCA News letter dated 27.5.2016 issued after their meeting with you on 26.5.2016that the Department of Pension is opposed to the first option recommended by the 7th CPC to bring about the parity with the past pensioners, as they consider it to be infeasible and impracticable (due to the non-availability of the requisite records)

3. It is hard to believe, how a department meant for the welfare of pensioners which helped pensioners to get better deal in earlier pay commissions could arrive at such a damaging and misleading decision without even consulting the stake holders.

4. Sir, Service record is a permanent one and if it to be destroyed, proper permission from the Competent Authority is to be obtained. In any case, service record of pensioners can always be reconstructed taking the details from various sources available with the department and the material collected from the Pensioner. This has been done in the past while implementing parity enunciated by fifth CPC and even while implementing modified parity of 6th CPC. It is also being done now implementing OROP. In this regard Your kind attention is also drawn to recent Bombay High court Nagpur judgement dated 09.03.2015 in case of Smt. Saija v. General Manager, Central Railway O.A.No. 2131 of 2011 (Bombay Bench at Nagpur)
Undersigned in the capacity of Secy. Genl ‘Bharat Pensioners Samaj’ request you to takean independent decision in view of submission in Para 4 above to save pensioners/family pensioners from unprecedented permanent damage by a department meant for their welfare.

Finance Ministry Inspectors Furious over 7th Pay Commission Recommendation – The agitated inspectors claim that they will be drawing less salary than inspectors attached to other ministries.

The 7th pay commission has recommended for Income Tax, Central Excise and Customs and Service Tax department which works under finance ministry, a grade pay of Rs.4600. However for CBI, IB, Delhi Police inspectors etc the recommended grade pay is Rs.4800.

On an average the Inspectors of various departments of finance ministry bring revenue to the Government to the tune of around 7000 crores in a year.

The Inspectors attached to the finance ministry are not happy with the 7th pay commission recommendations, however they are more furious that their voice has not been listened by their higher officials and by the empowered Committee of Secretaries as well. The agitated inspectors claim that since independence this will be the first time they will be drawing less salary than inspectors attached to other ministries, thanks to the 7th pay commission, they say.

The 7th pay commission has recommended only replacement scale for Income Tax, Central Excise and Customs and Service Tax department which works under finance ministry. In other words, 7th pay commission has proposed the revised pay only on the basis of their present grade pay which is Rs.4600 for these Officers. However for CBI, IB, and Delhi Police inspectors etc 7th pay Commission has recommended revised pay on the basis of upgraded grade pay of Rs.4800.  Presently, CBI, IB, and Delhi Inspectors are getting a grade pay of Rs. 4600 at par with Central Excise, Customs and Income Tax Inspectors.

Inspectors working under the Ministry of Finance feel that the 7th Pay Commission recommendations not only reduces their salary but also breaks their morale, because till date they have been treated equally with their ranks in other departments, however the 7th CPC recommendation makes them inferior, though in the same rank.

Ashok Kumar Knnojia, representing the Group B and Group C employees in the IT department said they are more pained by the response of their own higher officials than the 7th pay commission. He said, though the 7th pay commission did injustice to us, our own higher officials who should have raised the voice strongly lost in presenting our plight to the empowered Committee.

As per Mr. Ashok Kumar, they were unable to get an appointment to meet their own department secretary. After a big struggle he did meet him and expressed the plight of the inspectors, however Mr. Ashok said, till date there is no positive response.

There are more than 32,000 inspectors working in Income Tax, Central Excise and Customs and Service Tax department which comes under finance ministry.

The notification to put into effect the 7th pay commission recommendation will be issued after the completion of states assemblies’ poll process as the model code of conduct is currently in place, sources of Finance Ministry said on Wednesday.

The assemblies’ election of Tamil Nadu, West Bengal, Assam, Kerala and Puducherry states, which will be held from April 4 to May 16 and the counting of votes in the states will take place on May 19 but the model code of conduct will remain in place till May 21.

So, it is believed that the government will announce 7th pay commission award after the end of model code of conduct of states assemblies election.

The government doesn’t want to give any chance to the Opposition to deter its image in the polls and hence, sources, said that the announcement of the dates of the the model code of conduct of states polls seems to be the cut-off point for notification of the 7th pay commission award.

The 7th pay commission recommendations will benefit 48 lakh central government employees and 52 lakh pensioners including dependents.

“The BJP led central government decided execution time of the pay commission’s proposals in April but the Empowered Committee of Secretaries headed by cabinet Secretary can’t sort out some anomalies of 7th pay commission recommendations like scrapping of advances, allowances and minimum pay before declaration of states Assemblies polls,” sources said.

Sources also said the Implementation cell of the Empowered Committee of Secretaries for the 7th pay commission recommendation in Finance Ministry works hard to send a summary of the pay commission implementation to PMO for its nod. After PMO’s nod, it would be placed before the cabinet for its nod through cabinet secretary.

Sources said the 7th Pay Commission recommendations implementation notification will be issued in June, after cabinet nod.

The 7th Pay Commission was set up by the UPA government in February 2014, The Commission headed by Justice A K Mathur submitted its 900-page final report to Finance Minister Arun Jaitley on February 19, recommending 23.55 per cent hike in salaries and allowances of Central government employees and pensioners.

The panel recommended a 14.27 per cent increase in basic pay, the lowest in 70 years. The previous 6th Pay Commission had recommended a 20 per cent hike, which the government doubled while implementing it in 2008.

The 7th pay commission recommended fixing the highest basic salary at Rs 250,000 and the lowest at Rs 18,000and its increased the pay gap between the minimum and maximum from existing 1:12 to 1: 13.8
The government constitutes the Pay Commission almost every 10 years to revise the pay scale of its employees and pensioners, often these are adopted by states after some modifications. However, the 7th Pay Commission suggested to discontinue the practice of appointing pay commissions in future.
