Dear Comrades,
Please refer to the Confederation Circular dated 25- 06-2018 wherein the Resolution & declaration, Programme of action and charter of demands adopted in the 10th June 2018 National Convention of Central Govt. Employees are published. A very big mass rally will be organised at New Delhi on 05-09-2018 along with State Government employees, Public sector employees and other class and mass organisations. Quota fixed for each affiliate and C-O-Cs are furnished below. Regarding accommodation etc. for the participants in the rally, each organisation/C-O-C shall make their own arrangements. Up and down travel tickets of the participants should be booked well in advance. As State Govt. Employees etc. are also participating in the rally, it will be difficult to get confirmed tickets in the last minute. All affiliates and C-O-Cs are requested to finalise the delegates of each unit and first priority may be given for booking tickets. For any help at New Delhi, C-O-C, Delhi State Committee may be contacted.

Sir,
Indian National Defence Workers Federation in its 21st Conference held on 21nd and 22nd March, 2017 unanimously resolved to conduct agitation programme from 24.04.2017 to 29.04.2017 in order to demand Ministry of Defence and Government of India to settle the demands.

INDWF being one of the constituent organisations of National Council (JCM) under the National Joint Council of Action (NJCA) of Central Government Employees. NJCA deferred the proposed Indefinite Strike which was to commence from 11.07.2016 based on the assurances given by the group of Ministers Chaired by Shri Rajnath Singh, Hon'ble Home Minister that Government will constitute committee on on Minimum Pay, Fitment Formula, Allowances, NPS and Pre-2016 pensioners. It was also the National Council (JCM) within 4 months. However, even after more than 6 months it is regretted to note that none of the demands of the NJCA pertaining to 7th CPC are accepted by the Government Employees in genera and Defence Civilian Employees in particular.

In addition to the above, it is to be pertinent to mention that the Government is going ahead very fast to privatise and outsource the entire defence production activities. We are in dark about the development which is taking place about the letter received from Hon'ble Prime Minister's office to the Department of Defence Production and OFB asking various information's of the production activities of the above unhelpful attitude and decision of Government of India and Ministry of Defence, the Defence Civilian Employees are very much agitated in this regard. Therefore, the Indian National Defence Workers Federation has decided to observe All India Demand Week from 24.04.2017 to 29.04.2017 by holding gate meetings, demonstration, wearing demand badges and submit memorandum for your favourable consideration and for early settlement of these demands.

CHARTER OF DEMANDS

1. Stop privatisation and outsourcing of Defence Production and withdraw 100% in Defence

2. Fill up all the existing vacancies including freezed vacancies during the period of ban on recruitment considering the increased work load.

3. Withdraw NEW PENSION SCHEME (NPS) for the Defence Civilian Employees and extend Defined Pension facilities at par with Armed Forces personnel as per CCS Pension Rules 1972 ensuring 50°/o pension on the last pay drawn and also extend Family Pension. Disability pension.

4 Regularise all the Casual. Contract, Outsource employees, Part time employees employed in permanent and perennial jobs.

5. Withdraw arbitrary decisions of stopping detailment of employees on Sundays/Holidays working in Ordnance Factories in order to achieve the projected targets.

6. Early implementation of granting of Allowances on 7m CPC Pay scales on HRA, TA and Other Allowances. Revise the Minimum Pay, implement 7th CPC recommendation of Option-I for pensioners and accepted by Government regarding pension of pre-2016 Pensioners without any further delay

Sub: Charter of demands - Deferment of "Strike Action" on Government's assurance-reg.


At the outset, NFIR conveys its thanks to the Hon'ble Railway Minister for his initiative which had culminated into a meeting with the Group of Ministers (Hon'ble Finance Minister, Home Minister, Railway Minister and the Minister of State for Railways) on 30th June 2016 and also a separate meeting with the Hon'ble Home Minister on 06th July 2016. Pursuant to the discussions in those meetings held between the NC/JCM (Staff Side) Leaders and the Hon'ble Ministers, an assurance was given by the Government on 6th July, 2016 that High Level Committee would consider 7th CPC issues - Minimum Wage and Multiplying Factor etc., for satisfactory settlement through discussions.

Federation is disappointed to mention that although a Committee headed by Addl. Secretary (Exp), Ministry of Finance, was constituted and a few meetings were held with us, there has been no satisfactory progress. The main issues - Minimum Wage and Multiplying Factors are continued unresolved. Due to procrastination of the matters, the Central Government employees in general and Railway employees in particular are seriously disappointed as they feel that the Government is not sincere to fulfill its assurances. The National Convention of NFIR held at Guwahati from 9th to 11th November, 2016 has expressed grave concern over non- fulfillment of assurance and decided to mobilize railway employees for sustained struggle.

NFIR, therefore, requests the Hon'ble MR to kindly apprise the disappointed feelings of the employees to the Hon'ble Prime Minister for his intervention to resolve the 7th CPC related issues - mainly improvement of Minimum Wage and Multiplying Factor through discussions with the Staff Side Federations very soon in order to preserve the healthy industrial relations in Railways.

12 Point Charter of Demands – General Strike 02/09/2016

2016 September 2nd General Strike 12 Point Charter of Demands of Joint Platform of Central Trade Unions submitted to government:

PART A

1. Urgent measures for containing price rise through universalization of public distribution system and banning speculative trade in commodity market.

2. Containing unemployment through concrete measures for employment generation.

3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.

4. Universal social security cover for all workers.

5. Minimum wage of not less than 18000/- per month with provisions of indexation (for unskilled worker).

6. Assured enhanced pension not less than 3000 p.m for the entire working population (including unorganized sector workers).

7. Stoppage of disinvestment in Central/state public sector undertakings.

8. Stoppage of contractorisation in permanent/perennial work and payment of same wage and benefits for contract workers as that of regular workers for the same and similar work.

9. Removal of all ceilings on payment and eligibility of bonus, provident fund and increase in quantum of gratuity.

10.Compulsory registration of trade unions within a period of 45 days from the date of submitting application and immediate ratification of ILO conventions C-87 and C-98.

11.No FDI in Railways, Defence and other strategic sectors.

12.No unilateral amendment to labour laws.

PART B

Demand of the Central Govt. Employees

1. Avoid delay in implementing the assurances given by Group of Ministers to NJCA on 30th June 2016, especially increase in minimum pay a fitment formula. Implement the assurance in a time bound manner.

2. Settle issues raised by the NJCA, regarding modifications of the 7th CPC recommendations, submitted to Cabinet Secretary on 10th December 2015.

3. Scrap PFRDA Act and New Pension System (NPS) and grant Pension/Family Pension to all Central Government employees under CCS (Pension) Rules 1972.

4. No privatization, outsourcing, contractorisation of Government functions.

5. (i) Treat Gramin Dak Sevaks as Civil Servants and extend all benefits on pay, pension and allowances of departmental employees.
(ii) Regularise casual, contract, contingent and daily rated workers and grant equal pay and other benefits.
6. Fill up all vacant posts by special recruitment. Lift ban on creation of new posts.

7. Remove ceiling on compassionate appointments.

8. Extend benefit of Bonus Act amendment 2015 on enhancement of payment ceiling to the Adhoc bonus/PLB of Central Govt. employees with effect from the financial years 2014-15. Ensure payment of revised bonus before Pooja holidays.

9. Revive JCM functioning at all levels.

In continuation of communication dated 30/06/2016, it is to inform that as a result of General Secretary NFIR’s discussion with Shri Suresh Prabhu, Hon’ble MR at 15:30 hrs., on 30/06/2016 on the Charter of Demands in general and major demands i.e. minimum wage’ multiplier factor in particular Hon’ble MR has assured to approach Hon’ble Prime Minister. Pursuant to the efforts of GS/NIFIR, the CRB telephoned Shri Raghavaiah at 18:45 hrs., on 30/06/2016 that the Federations have been invited to meet Hon,ble Finance Minister at the residence of Shri Rajnath Singh, Union Home Minister at 21:30 hrs, on 30/06/2016. Accordingly the undersigned reached the residence of Union Home Minister and participated in the discussions. Besides Hon’ble Finance Minister Shri Arun Jaitely, Shri Suresh Prabhu Hon’ble MR and Shri Manoj sinha Hon’ble MoSR were present during discussions. union Home Minister

Shri Rajnath Singh also participated in the discussions After 90 minutes discussions, it has been emerged that the “Minimum Wage” issue will be referred to the Committee to examine and give report. In view of this development, the NJCA met this date (1st July 2016) and having taken stock of the situation has decided to meet again on 06th July 2016 for taking appropriate decision. In the meanwhile, efforts will be made for obtaining written  communication as a follow up to the meeting held at the residence of Union Home Minister Shri Rajnath Singh on 30th June 2016. A copv of letter dated 01st July 2016 issued by NJCA Convener is enclosed.

Kind attention is invited to the references cited above on the pending issues of Railway employees as also the issues arisen consequent upon retrograde recommendations of 7th CPC.

During the. meeting of Empowered Committee of secretaries held on 1St March 2016 under the Chairmanship of Cabinet Secretary, the JCM (Staff Side) Members have explained on 26 point Charter of Demands and “Strike Decision” in the event negotiated settlement is not reached. After hearing the JCM (Staff Side) Members, on each issue listed in the Charter of Demands, the Cabinet Secretary said that adequate time is needed to facilitate inter-departmental consultations to crystallize the issues to be processed further. Responding to the suggestion of Cabinet Secretary, the “strike date” has been deferred, hoping that there will be a negotiated settlement on the demands by the end of May 2016.

There are many Railway specific issues which were discussed at the level of CRB & MS on 23/08/2013, 07/02/2014, 20/07/2015, 01/10/2015, 04/02/2016 & 08/02/2016. Consequently, records note of discussions were circulated. In this connection, kind attention is invited to Railway Board’s references No. 2013/E(LR)-IU1/15 dated 02/09/2013, 2013/E(LR)II/1/17 dated 18/02/2014, 2015/E(LR)IU13/3 dated 07/08/2015, 2015/E(LR)II/1/8 dated 27/10/2015, 2015/E(LR)II/1/8 dated 30/11/2015, 2015/E(LR)II/1/8 dated 08/03/2016 & 2016/E(LR)II/1/2 dated 14/15-03-2016.

It is however noticed that commitments given by the Board pursuant to discussions are yet to be implemented. Some issues dealt in the Fast Track Committee meetings and Running Staff issues discussed in the Joint Committee Meetings are yet to be resolved satisfactorily. Orders for stepping up of pay of Loco Inspectors inducted prior to 01/01/2006 have not been issued yet even though SLPs were dismissed by the Apex Court.

The delay in finalizing the pending issues is contributing serious unrest among staff of various categories. Added to this situation, the negative and retrograde recommendations of the VIIth Central Pay Commission have generated anger and frustration among Technicians, Technical Supervisors, Running Staff, Safety categories staff, Supervisory Officials, Railway common categories staff etc.

You are aware that in the interaction meeting of Empowered Committee of Secretaries held on 30th March 2016 under the chairmanship of the Cabinet Secretary, the Federations have explained the uniqueness of Railways and complex and difficult nature of working of Railway employees and the need for modification of 7th CPC recommendations and also rectification of VI CPC anomalies by implementing the agreements reached with the Railway Ministry. The need for exemption of Railways from National Pension System (NPS) and the communications sent by Hon’ble Railway Ministers to this effect to the Hon’ble Finance Minister have also been apprised to the chairman of the Empowered Committee of Secretaries on 30th March, 2016.

As the time is running out, the NFIR once again requests the CRB to kindly take special initiative towards resolving the issues through negotiated settlement at the earliest for preserving industrial peace in the Railways.
