AICPIN for the month of July 2018
The All India Consumer Price Index Numbers for Industrial Workers on base 2001=100 for the month of July 2018 is increased by 10 points and stands at 301.
Dearness Allowance for Central Government Employees (also Dearness Relief for Central Government Pensioners) is calculated based on All India Consumer Price Index Numbers declared by Labour Bureau under Ministry of Labour and Employment in the last day of every month.

DA and DR to existing employees and pensioners is being given twice in a year, i.e., Jan to Jun and Jul to Dec.

This year first instalment of DA and DR from January to June 2018 approved by the Cabinet Committee and waiting for Finance Ministry Notification.

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modihas approved to release an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners w.e.f. 01.07.2018 representing an increase of 2% over the existing rate of 7% of the Basic Pay/Pension, to compensate for price rise.

The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs.6112.20 crore per annum and Rs.4074.80 crore in the financial year 2018-19 (for a period of 08 months from July, 2018 to February, 2019).

This will benefit about 48.41 lakh Central Government employees and 62.03 lakh pensioners.
This increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.

Attention is invited to instructions contained in Board's letter no. E(NG)II/2007/RR-1/10/Pt.(110865) dated 25.06.2014 specifying the carious factors which must be taken into account while computing vacancies for placing indents. It was inter alia mentioned therin that staff likely to go on transfer to other Railways/Divisions in a particular calendar year must also be accounted for in the pool of vacancies while placing indents with the Recruiting Agencies.

It has been observed that large number of applications for Inter Railway transfers are pending on Railways. Such transferd have a direct bearing on railway working, especially in terms of manspower because of huge gap between outflow and inflow of staff.

It is, therefore, reiterated that while placing indents for fresh recruitment notifications in future the computation done duly of vacancies must be done duly taking.into account all the pending requests of Inter-Railway transfers. For this purpose, requests forwarded to the recipient Railway/Division as on the cut off date of assessment of vacancies should be regarded as pending requests. Action may be taken accordingly henceforth.

Subject: Nationwide rollout of India Post Payments Bank - regarding arrangements and nomination of nodal officers for monitoring of preparations in Circles.

The Department of Posts is rolling out 650 branches and 3250 access points of India Posts Payments Bank (IPPB) simultaneously across the country on 1st September 2018. The Hon'ble Prime Minister of India has kindly agreed to preside over the national level launch function which is scheduled at Talkatora Stadium, New Delhi. Several Governors / Chief Ministers / Union Ministers / State Ministers / Member of Parliaments 1 Member of Legislative Assembly and other dignitaries and important personalities will be presiding the launch functions at 650 branches and 3250 access points which are being organized by the Circles across the country. The branch / access points level launch functions in the Circles will precede national level launch function at New Delhi. The combined Minute to Minute Programme for national and branch / access points level function is enclosed at Annexure - I.

The presence of Hon'ble Prime Minister and other important dignitaries / personalities in the branches and access points of IPPB across the country to simultaneously launch DoP's flagship project 'India Post Payments Bank' in 650 branches and 3250 access points will not only be historic in several aspects but will also provide massive outreach opportunity for the Department of Posts and India Posts Payments Bank (PPB) together.

Heads of Circles have been requested by the PBI Division to meticulously organize launch functions and put their best efforts at their disposal to make the simultaneous launch a grand success. The broad guidelines and checklist for organizing the launch events have already been shared with the Circles and Circles are already making adequate preparations accordingly.

Hon'ble Minister and Secretary (Posts) have been regularly reviewing the preparations of launch with HoCs and important suggestions / guidelines are given to Heads of Circles are also given responsibility of taking local level decision to organize the launch rather than waiting for instructions / guidelines from Directorate. The review meetings are being organized at the office of MoSC (I/C) on daily basis to monitor the preparations in the Circles which are currently being represented by PSI Division, IPPB and Delhi Circle. Secretary (Posts) has organized VC meetings with HoCs I PMsG I DPS which were webcasted also for larger audience in last two weeks.

Since the scale of the function is massive, it has been decided by the competent authority to nominate few SAG level officers working in the Dak Bhawan as nodal officers for reviewing preparations of the Circles for branch / access points launches and give Circle wise status update to Secretary (Posts) to appraise the Hon'ble Minister. The name of the officers and name of the Circles for which they are responsible for ensuring organization of successful launch functions is at Annexure -II. The nodal officers will continue to monitor the performance of Circles till the 100 days' rollout targets given to the Circles for customer and merchant onboarding Is successfully over.

The Heads of Circles are requested to liaison with the nodal officer for their Circle and seek support, if any, for the launch of IPPB in the Circles. They are requested to send a daily status update on the list of activities indicated in this letter to the nominated nodal officers by 4.00 pm on daily basis including weekend (25th & 26th August 2018).

The list of activities which are requested to be monitored / reviewed by the HoCs and nodal officers on daily basis is at Annexure - III. The list of activities is non-exhaustive and only indicative. Circle Heads I Nodal Officers are requested make suitable changes in the list, if required for review.
The overall responsibility of successfully organizing launch functions in the Circles rest with Head of Circles. The concerned CPMsG / PMsG / DPS should visit all venues of the branch and access points launch functions personally and physically verify the preparations / arrangement for the launch in terms of

a) Cleanliness post offices I venue where launch function is organized
b) Preparations for filling the venue to capacity including security
c) Coordination with District Administration / Police / Mayor Office / Municipalities
d) Arrangements for broadcast I webcast of national level launch function
e) Dais plan / seating arrangement! Backdrop
f) Placement of hoarding I signage of IPPB
g) Distribution of flyers! leaflets on IPPB
h) Branches are operational and transactions are taking place
i) End Users are adequately trained I retrained
j) Any other arrangement I preparation for safe and successful launch

The responsibility of organizing national level launch function at Talkatora Stadium, New Delhi which will be presided over by the Hon'ble Prime Minister has already been given to CPMG, Delhi Circle. CPMG, Delhi Circle is attending review meeting at the office of MoSC (I/C) on daily basis and reviewing the progress of activities against a checklist. CSMO (IPPB) and his team is supporting CPMG. Delhi Circle for the National Level launch function and will continue to do so till the launch function is successfully over.

Secretary (Posts) will chair review meeting at 5.30 pm In the Board Room on dally basis from 23fd August 2018, to review the preparations of nationwide rollout of IPPB with nodal officers and CPMG Delhi Circle. DG (Post), Member (Technology) and CEO (IPPB) are also requested to attend the daily review meeting chaired by Secretary (Posts) at 5.30 pm in the Board Room.

Since a large number of dignitaries / guests / customers / public would be visiting Post Offices during the launch events which will provide huge outreach opportunity to the Members of Postal Services Board are requested to kindly review their areas of operations / services and take necessary action as well as issue necessary instructions to the Circles, if any. so that opportunity can be appropriately utilized by the Department for improving the image of the Department. Special focus may be given to the Customers and on Cleanliness of Post Offices.

All officers / employees of the Department of Posts and India Post Payments Bank (IPPB) are requested to constructively involve themselves with the launch function to make it a grand success.

It is to inform that Govt. of India vide its OM No. 42/14/2016-P&PW(G) dated 24.10.2016 has provided an option to the pensioners retired between 01.01.2016 to 04.08.2016, in relaxation of Rule 10 of CCS (Commutation of Pension) Rules,1981, not to commute the pension which has become additionally commutable on revision of pay/pension on implementation of recommendations of the 7th CPC.

Sub: Grant of financial upgradation under ACP & MACP schemes for the central Government Civilian Employees including Railway employees - reg.

Ref: (i)  Dop&T oM No.35034/1/97-Estt (D) dated 09/08/1999.
        (ii) Dop&T oM No.35034/3/2008-Estt (D) dated 19/05/2009.

NFIR invites kind attention to the OM dated 09/08/1999 wherein the Government of India (DoP&T) had introduced 'Assured career Progression Scheme' (ACPs) for the central Government civilian Employees pursuant to the recommendation of 5th central pay commission. The ACP Scheme was made effective in the Central Government departments from 1999. The ACP Scheme remained functional until 31/08/2008 (as clarified by the DoP&T vide para 9 its OM dated 19/05/2009) due to the fact that the 'Modified Assured Carrer Progression Scheme' was introduced by the DoP&T, replacing ACPS w.e.f. 01/09/2008, pursuant to the recommendations of 6th CPC.
The Federation has however been receiving representations from the Central Government civilian Employees, mainly railway employees from all corners of the country to make the MACP Scheme operational w.e.f. 01/01/2006
01/01/2006 instead from 0l/09/2008, pursuant to the order dated 08th December, 2017 passed by the Hon'ble Supreme Court in Civil Appeal Diary No.3744 of 2016. In this connection, NFIR places following facts for consideration:-
  • on perusal of the order of the Apex court, it is found that the Hon'ble Apex court has held that the MACP is a part of pay structure recommended by the 6th CPC, the same cannot be considerd as allowance which had been given effect from 01/09/2008. The said order has also cited the Resolution dated 30/08/2008 of the Government which was referred in the notification issued by the Ministry of Finance wherein MACP has been defined part of 'Pay structure' and not as 'Allowance' and therefore should be given effect from 01/01/2006.
  • The order dated 8th Dec 2017 passed by the Apex court has already been implemented by the Ministry of Defence, giving effect to the MACPs w.e.f.01/01/2006 through an OM dated 25/07/2018.
  • DoP&T may kindly take note that in para 6.5.2 & 6.5.4 of the report of 6th CPC, the Commission had recommended for implementation of the revised pay structure consisting of Pay Band and Grade Pay w.e.f. 01/01/2006 while the revised allowances were given effect from prospective date i.e. 01/09/2008.
  • Ministry of Finance vide Gazette of India, Extraordinary Notification of Resolution No. 1/1/2008-IC dated 29/08/2008 had implemented revised pay structure (Pay Band & Grade Pay) w.e.f. 01/01/2006 whereas the implementation of MACPS was made effective from 0110912008, Accordingly, Ministry of Railways also implemented revised Pay structure w.e.f. 01/01/2006 vide its order dated 04/09/2008 while the rates of Non Practicing Allowance (NPA) were revised w.e.f. 01/01/2006 vide Board's order dated 22/09/2008. Therefore, the MACPS which is part of Pay structure as decided by Apex Court should be given effect from 01/01/2006 in railways and all other Central Government departments.
  • Another important fact which cannot be ignored is, that the Apex Court had held that the benefit of ACP granted to an employee is part of the Pay structure which not only affects the pay but also pension of the employee, therefore, decided that the ACP is not allowance but a part of pay. At the same time, the Hon'ble Supreme Court further held that there can be no dispute that grant of ACP is part of pay structure and that the resolution dated 30/08/2008 relating to implementation of 6th CPC recommendations on pay structure, pay bands, grade pay etc have been given effect from 0110112006 and also added that this is the decision of the Cabinet which could not have been modified by issuing executive instructions.
  • NFIR suggests that while issuing modified instructions, in compliance with Apex Court order, the DoP&T may allow option opportunity to all those beneficiaries of ACPS as well MACPS to exercise their option for financial upgradation from the dates advantageous to them so as to avoid further grievances.
  • Summing up, NFIR urges upon the DoP&T to kindly consider the above points and issue modified instructions for granting financial upgradation under MACPS with effect from 01/01/2006 as was done by the Ministry of Defence. A copy of the instructions issued may be endorsed to this Federation.

While appreciating the prompt reply of the Railway Board not agreeing with the proposal made by the Federation through its letter dated 22/6/2018, NFIR reiterates again the following facts:

• There are many places where there is no rest house at all,
• Wherever there are rest houses for subordinate staff, their accommodation is totally inadequate and the employees do not get even Cot/Bed,
• The condition of rest houses is very bad so much so, the bed sheets, pillow covers etc., are not even washed regularly (i.e. the condition is unhygienic),
• Mattresses in the rest houses are very dirty and not fit for use.

The Railway Board's contention for denying the legitimate entitlement, citing 7th CPC recommendation and Government of India’s approval thereon is not only illogical but also highly improper. It needs to be appreciated that when employee is ordered to undertake tour on duty, he is rightly entitled for facilities as well Daily Allowance / Travelling Allowance. The case cited by NFIR is that in those cases where the staff proceed on duty to other places where the rest house facility is not available or condition of rest house is so bad that no human being can live, in such situations the reimbursement of hotel charges has to be ensured by the employer. Therefore the simple reply in one paragraph given by the Railway Board not agreeing the legitimate demand of NFIR is unacceptable to the Federation and we surmise that the Railway Board never wanted to take the ground situation into consideration for extending legitimate benefit to the staff. It is also unfortunate that while the Central Government has allowed reimbursement charges towards hotel accommodation to its employees when they undertake tour on duty, the Railway Board is unwilling to adopt Government of India’s rules probably with an intention to deny the legitimate benefit%to railwaymen deliberately.

Federation therefore urges upon the Railway Board to review the matter with judicious intention and issue instructions to the GMs etc., for ensuring reimbursement of accommodation/rest house/hotel charges in those cases where the resting facilities or either inadequate or not provided or not available.

Please refer to Board's letter of even number dated 12.10.2017 (RBE No.147/2017) followed by subsequent clarifications thereon regarding grant of CEA and Hostel Subsidy to Government employees on the recommendations of the Seventh Central Pay Commission.

Now, the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel & Training), vide their OM No.A-27012/02/2017-Estt.(AL) dated 16/17.07.2018 (Copy enclosed) has issued consolidated instructions in supersession of all the earlier instructions on the subject of CEA and Hostel Subsidy to Government Servants. These instructions shall apply mutatis-mutandis to Railway Employees with effect from 1.7.2017.

These instructions on CEA and Hostel Subsidy are in supersession of all previous orders issued by the Ministry of Railways on the subject.

Please refer to NFIR's representation dated 23.07.2018 addressed to Hon'ble MR requesting intervention of Hon'ble for obtaining approval of Ministry of Finance (MoF) for upgradation GP-4600 to GP-4800.

2. With respect to above, it is stated that Railway Board have been making persistent efforts with various levels for obtaining approval of proposal sent MoF vide Board's OM dated 08.02.2017 proposing revision of pay structure of Sr.Supervisors in Group 'C' of all departments (other than Account Department) to upgrade 75% of such Supervisor posts from Level-7 (erstwhile GP-4600) to Level-8 (erstwhile GP - 4800) and to bring parity in the pay scales of Group 13 Officers Accounts/Non-Accounts department.

3. It has already been intimated to NFIR through ATS on PNM-NFIR Item Nos. 3 & 10/2018 that a D.O. letter dated 20.04.2017 was sent from Hon'ble MR to Hon'ble FM for expediting approval on above proposal. Seven day State Mourning to be observed in memory of former Prime Minister Shri Atal Bihari Vajpayee

The Government of India announce with profound sorrow the death of Shri Atal Bihari Vajpayee, former Prime Minister of India on 16th August, 2018, at AIIMS Hospital, New Delhi.

As a mark of respect to the departed dignitary, it has been decided that seven days of State Mourning will be observed throughout India from 16.08.2018 to 22.08.2018, both days inclusive. During this period the National Flag will be flown at half mast throughout India where it is regularly flown and there will be no official entertainment during the period of State Mourning. It has also been decided that the State Funeral will be accorded to late Shri Atal Bihari Vajpayee at Smriti Sthal, New Delhi.

All Central Government offices and CPSUs across the country, and Delhi Government offices in NCT of Delhi will observe half day holiday in the afternoon of day of funeral.

National Flag shall also fly half mast till 22.08.2018 in all Indian Missions/High Commissions of India abroad.

Subject: Grant of additional HRA to the civilian employees of the Central Government serving in the States of North Eastern Region, Andaman & Nicobar Islands, Lakshadweep Islands and Ladakh.

Consequent upon revision of rates of House Rent Allowance (HRA)/additional HRA w.e.f. 01.07.2017 vide this Department’s O.M. No.2/5/2017-E.ll(B) dated 07/07/2017 and O.M. of even number dated 19.07.2017 respectively, it has been decided to grant additional HRA at old duty station w.e.f. 01.07.2017 to all those Central Government civilian employees who have been transferred to North Eastern Region, Andaman & Nicobar Islands, Lakshadweep Islands and Ladakh, prior to 01.07.2017 or after 01.07.2017 and continue to remain posted there after 01.07.2017, as under:-
(i) ln case of civilian employees of Central Government transferred to and posted from a date prior to 01.07.2017 who leave their families behind at the old duty station, the HRA of the old duty station will be calculated on the revised pay drawn on 01.07.2017 with the percentage rates of HRA effective on 01.07.2017 as per 0.M. No. 2/5/2017.E.ll(B) dated 07/07/2017.

(ii) In case of civilian employees of Central Government transferred to and posted from a date on or after 01.07.2017 who leave their families behind at the old duty station, the HRA of the old duty station will be calculated on the revised pay drawn on the date of transfer with the percentage rates of HRA effective on the date of transfer.

G.S.R. 767(E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely :-

1. Short title and commencement.- (1)These rules may be called the Fundamental (Second Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Fundamental Rules, 1922, in rule 56, for clause (bb), the following shall be substituted, namely: "(bb) (i) The age of superannuation in respect of the doctors belonging to -

(i) Central Health Service;
(ii) Indian Railways Medical Service;
(iii) AYUSH and working under the Ministry of AYUSH;
(iv) Civilian doctors under the Directorate General of Armed Forces Medical Service;
(v) Medical Officers of the Indian Ordnance Factories Health Service;
(vi) Dental Doctors under the Department of Health and Family Welfare;
(vii) Dental doctors under the Ministry of Railways; and
(viii) General Duty Medical Officers, Specialist Grade doctors and Teaching Medical Faculty working in Bhopal Memorial Hospital and Research Centre,

shall be sixty-two years unless they exercise the option of posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy depending on their expertise and experience, as decided by the competent authority in the concerned Ministry or Department from time to time, in case they desire to continue in their service upto the age of sixty-five years:

Provided that the age of superannuation in respect of the doctors belonging to the General Duty Medical Officers sub-cadre of Central Armed Police Forces and Assam Rifles and Specialist Medical officers of Central Armed Police Forces and Assam Rifles shall be sixty-five years.

(ii) The serving doctors belonging to the services referred to in sub-clause (i) who have either already attained the age of sixty-two years or attaining the age of sixty-two years within six months from the date of publication of these amendment rules in the Official Gazette, may exercise their option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018.

(iii) The serving doctors who fail to exercise the option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within the period specified in sub- clause (ii), shall be superannuated form their service on attaining the age of sixty-two years or on expiry of a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018, whichever is later."

1. a) We seek your kind intervention on date of implementation of MACPS w.e.f 1.1.2006 (instead of 1-9-2008) as has been held by the Supreme Court of India vide its judgment cited above wherein MACPS has been held to be a part of pay structure recommended by 6th CPC and not to be considered as allowance which were implemented from 1.9.2008. The judgement has cited the Resolution of the Government of India dated 30-8-2008 referred to above as Notification of MOF where in in MACPS has been defined as Pay and not as Allowance and has thus to be allowed from 1-1-2006.

b) Consequent upon the said judgment of the Supreme Court Judgement Ministry of Defense made the MACP Scheme operational from 01.01.2006 vide its orders dated 25-7-2018 cited above.

2. Sixth CPC Recommendations on Date of implementation:
a) Reg. Pay Structure: 6 th CPC in para 6.5.2 & 6.5.4 of its report (Annexure-I) had recommended for implementation of revised scheme of pay bands and grade pay as on 1/1/2006 retrospectively
 b) Reg. Allowances: 6th CPC had recommended for implementation of revised allowances to take effect prospectively.
c) Reg. Pay: 6th CPC had recommended for implementation of revised pay retrospectively from 1-1-2006, as clear from the relevant Para reproduce below:
6.5.2. The Commission has devised the revised scheme of pay bands and grade pay on the basis of price index as on 1/1/2006. Consequently, the revised structure of pay bands and grade pay being recommended in this Report would need to be implemented from 1/1/2006. The Government will have to pay arrears of salary on account of fixation of pay in the revised pay bands and grade pay retrospectively with effect from 1/1/2006.

3. Ministry of Finance vide Gazette of India, Extraordinary Notification of Resolution No.1/1/2008-I C, dated 29.8.2008 had implemented revised pay w.e.f.1.1.2006. But it implemented MACPS and all allowances except DA w.e.f.1.9.2008. Relevant rules of finance ministry resolution is attached as
Annexure-II.

4. Ministry of Railways also implemented revised pay w.e.f.1.1.2006 and all allowances except DA w.e.f.1.9.2008. Relevant part of RBE No. 103/2008 dated 04.09.2008 is attached as Annexure-III

5. Railway Board implemented the revised rate of NPA effective from the date an employee drawing pay in the revised scale applicable to him in accordance with the provisions of the Railway Services (Revised Pay) Rules, 2008, i.e. w.e.f. 1.1.2006, vide its letter No. PCV/2008/A/O/1(NPA) (RBE No. 122/2008) dated 22.9.2008. Relevant part of RSRP is attached as Annexure-IV

6. It is very much evident that 6th CPC recommended MACPS as part of pay structure. Subsequent resolution issued by Finance Ministry, (relevant paras of resolution implemented revised pay w.e.f. 1.1.2006. Only the allowances were implemented w.e.f.1.9.2008 while the Pay & DA were revised w.e.f. 1-1-2006.

7. MACPS is a part of pay structure. But MACPS order have been implemented w.e.f.1.9.2008, which is against the 6th CPC recommendations and Government of India's resolution issued vide MOF Notification dated 29-8-2008.

8. A). Hon'ble Supreme Court of India in Civil Appeal Diary No.3744 of 2016 decided on 8-12-2017(copy of relavant para of judgemnt attached as Annexure-V) had held that the benefit of ACP granted to an employee is part of the pay structure which not only affects his pay but also his pension and, therefore, held that the ACP is not an allowance but a part of pay and will apply from 01.01.2006.
b). The Court had further ordered and held that there can be no dispute that grant of ACP is part of the pay structure.
C). Apex Court is very clear on its Judgement that, resolution dated 30.08.2008 on implementation of 6th CPC recommendations (with regard to pay structure, pay scales, grade pay, etc) are applicable from 01.01.2006. This is a decision of the Cabinet and could not have been modified by issuing executive instructions.
D). The apex court also disposed bunch of appeals by a common Judgement since similar questions of law are involved.

9. Consquent upon the Judgement of Honb'le Suprem Court, Ministry of Defence vide letter No.14(1)/99-D(AG), dated 25.07.2018 (copy attached as Annexure-VI) made the MACP Scheme operational from 01.01.2006.

10. It is also pertinent to mention that rules & procedures for MACPS is being followed uniformly for all Government employees irrespective of departments / ministries, who are all covered under Central Pay Commissions.

11. It is, therefore, requested that MACPS may please be implemented from 1.1.2006 since MACPS is part of pay structure - as recommended by 6th CPC, accepted by the Government of India vide its Resolution Dated 29-8-2008 and implemented by MoD consequent upon the Judgement of Hon'ble Supreme Court.

6.5.4. The Commission is of the view that prospective revision of various allowances is justified as their retrospective revision will give unintended benefits and may also, in some instances, cause loss to the employees as in the case of City Compensatory Allowance. Accordingly, the Commission's recommendations relating to allowances shall take effect prospectively. All recommendations relating to other facilities, benefits and conditions of service shall also take effect prospectively.

Ministry of Finance Gazette Extraordinary, No.1/1/2008-I C dated 29.8.2008

Govt. vide resolution dated 29.8.2008 has implemented revised pay w.e.f.1.1.2006 and all allowances except DA w.e.f.1.9.2008.
rule (iv) of rule 1. With regard to fixation pay in the revised pay bands, the basic pay drawn as on 1.1.2006 on the existing 5th CPC pay scales will be multiplied by a factor of 1.86 and then rounded of to next multiple of 10. This will be the pay in the revised running pay band. Grade Pay, as approved by Government,corresponding to the pre-revised pay scale, will be then added to the pay in the revised pay band. The total of pay in pay band and grade pay will be the revised basic pay as on 1.1.2006.
rule (vii) of rule 1. Three upgradation will be granted under Assured Career Progression (ACP) scheme at 10, 20 and 30 years as per Modified ACP scheme recommended by the Commission. ACP scheme will also applicable to Group "A" employees.
rule 3. The revised allowances, other than dearness allowance, will be effective from 1st day of September 2008.
Annexure-III

Ministry of Railways Notification RBE No. 103/2008 dated 04.09.2008

Sub rule (2) of rule1 - They shall deemed to have come into force on the 1st January 2006.
Sub rule (1) of rule 7 - The initial pay of Railway servant who elects, or deemed to have elected under sub rule (3) of rule 6 to be governed by the revised pay structure on or from 1 st January 2006, shall, unless in case the President by special order otherwise directs, be fixed separately in respect of substantive pay in the permanent post on which he holds a lean or would have held a lean if it had not been suspended, and in respect of pay in the officiating post held by him, in the following manner namely:-
(A) In the case of all employees
(i) the pay in the pay band/Pay scale will be determined by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding off the resultant figure to the next multiple of 10.

Railway Service (Revised Pay) Rules, 20008, No. PC-VI/2008/I/RSRP/1 (RBE No:108/2008) dated 11.09.2008

Rule 4. The revised rates of all allowances, such as House Rent Allowance, Transport Allowance, Children Education Allowance, Special Compensatory Allowance, Special Duty Allowance, Island Special Duty Allowance, Hard Duty Allowance etc will be paid prospectively w.e.f.1.9.2008. Accordingly no arrears will be paid in respect of these allowances. However, Dearness Allowances and non-practicing allowance for medical doctors at rates notified separately, will be payable w.e.f.1.1.2006 or from the date of option.

Para 2. This bunch of appeals is being disposed of by a common judgment since similar questions of law are involved.
Para 5. …. The AFT vide the impugned order dated 21.05.2014 held that the benefit of ACP granted to an employee is part of the pay structure which not only affects his pay but also his pension and, therefore, held that the ACP is not an allowance but a part of pay and, therefore, in terms of Clause (i) of the Government Resolution the MACP was payable w.e.f. 01.01.2006.
Para 6. The question that arises for decision is whether the benefit of MACP is applicable from 01.01.2006 or from 01.09.2008.
Para 7. The answer to this question will lie in the interpretation given to the Government Resolution, relevant portion of which has been quoted hereinabove. A bare perusal of Clause(i) of the Resolution clearly indicates that the Central Government decided to implement the revised pay structure of pay bands and grade pay, as well as pension with effect from 01.01.2006.The second part of the Clause lays down that all allowances except the Dearness Allowance/relief will be effective from 01.09.2008. The AFT held, and in our opinion rightly so, that the benefit of MACP is part of the pay structure and will affect the grade pay of the employees and, therefore, it cannot be said that it is a part of allowances. The benefit of MACP if given to the respondents would affect their pension also.
Para 10. As already held by us above, there can be no dispute that grant of ACP is part of the pay structure. It affects the pay of the employee and he gets a higher grade pay even though it may be in the same pay band. ….
Para 11. …… There may be some gainers and some losers but the intention of the Government was clear that this Scheme which is part of the pay structure would apply from 01.01.2006. We may also point out that the Resolution dated 30.08.2008 whereby the recommendation of the Pay Commission has been accepted with modifications and recommendations with regard to pay structure, pay scales, grade pay etc. have been made applicable from 01.01.2006. This is a decision of the Cabinet. This decision could not have been modified by issuing executive instruction. The letter dated 30.05.2011 flies in the face of the Cabinet decision reflected in the Resolution dated 30.08.2008. Thus, administrative instruction dated 30.05.2011 is totally ultra vires the Resolution of the Government.

(d) if so, the details thereof; and

There is also provision for creation of leave reserve posts to cover the leave vacancies. No centralized data is maintained in this regard.

We, on behalf of 32 lakhs Central Government employees and 33 lakhs Pensioners, seek your benign intervention to settle the following genuine grievances pending redressal for the last many years. We have brought these issues to the notice of the Central Government several times and also discussed in the negotiating forum which meets rarely. Inspite of our best efforts the issues could not be settled due to the unhelpful attitude of the Government. Having left with no other alternatives, we have been compelled to declare one day nationwide strike of Central Government employees on 15th November 2018. 1. Scrap Contributory Pension Scheme (Known as New Pension Scheme - NPS) and restore Defined Benefit Pension Scheme under CCS (Pension) Rules 1972 to all Central Government Employees, joined in service on or after 01-01-2004.
2. Honour assurance given by Group of Ministers to the Leaders of National Joint Council of Action (NJCA) of Central Government employees regarding increase in Minimum Pay and Fitment formula for Pay revision from 01-01­2016.
3. Regularisation and grant of Civil Servant status to Gramin Dak Sevaks of the Postal Department. Implement all positive recommendations of Kamalesh Chandra Committee report without any modifications or dilution
4. Pension Parity recommended by 7th Central Pay Commission (Option-I)
5. Filling up of all vacant posts. There are about six lakhs vacant posts remaining unfilled in various Central Government departments.
6. Stop closure of Government establishments
7. Implement 7th CPC wage revision and pension revision of all Autonomous body employees and pensioners.
8. Remove 5% condition imposed on compassionate appointments
9. Stop attack on trade union rights and ensure prompt functioning of various negotiating forums under the Joint Consultative Machinery (JCM) scheme at National and Departmental level.
10. Grant of five promotions during the entire service career of each employee .
At present almost all employees in the Group B and Group-C cadres retire from service with maximum three promotions only. Our request to ensure minimum five promotions in one's career is not considered favourably by Government.

The Grih Kalyan Kendra (GKK) is a registered Society under the Societies Registration Act, 1860, functioning under the aegis of Department of Personnel and Training, Ministry of Personnel Public Grievances and Pensions, Government of India. The GKK runs various welfare activities for the benefit of Central Government employees and their dependents.
  1. The main objective of the Kendra is to help the needy Central Government employees belonging to lower income groups, who are in genuine financial and psychological need of temporary rehabilitation, by giving them training and experience which would enable them to supplement their domestic income and help them to acquire skill and experience for seeking better avenues of employment elsewhere.

5. The workers in GKK are engaged initially for a period of one year. However, the engagement may be extended by the Competent Authority up to a maximum period of five years on year to year basis, subject to satisfactory performance and requirement for continuation of the post. The persons so engaged shall be paid a fixed monthly honorarium as mentioned above or as directed by the GKK Board from time to time.

6. It is requested that wide publicity may kindly be given to this circular amongst the Central Govt. employees working in the Ministry / Department including attached and subordinate offices, who may apply as per the enclosed format for the post for which they are eligible. The completed applications along with required documents may be forwarded to Secretary, Grith Kalyan Kendra, Samaj Sadan, Lodhi Road Complex, New Delhi - 110003 within a period of 30 days from the date of issue of this Circular, Applications completed in all respects, shall only be considered.

The below statement said in written reply to a question in Lok Sabha on 1st August, 2018 regarding steps taken to identify dull officers and action taken against such officers…

Review of performance of Government servants is an ongoing process under Fundamental Rule 56(j) and Rule 48 of Central Civil Services (Pension) Rules, 1972, which provide that the performance of a Government servant on attaining a specified age or qualifying years of service is to be reviewed and he/she can be retired in public interest.The instructions on the procedure to be adopted and various aspects to be kept in view while conducting periodical review under provisions of the said rules have been issued from time to time.

As per available information provided by cadre controlling authorities, performance of a total of 25,082 Group 'A' and 54,873 Group 'B' officers has been reviewed up to May 2018; and provisions of Fundamental Rule 56 (j)/ relevant rules were invoked/ recommended against 93 Group 'A' and 132 Group 'B' officers out of these.

Confidential Rolls (CRs) / Performance Appraisal Reports (PARs) of IAS officers are written for each financial year or as may be specified by the Government in the form and as per the schedule prescribed in the All India Services (Performance Appraisal Report) Rules, 2007. The appraisal form of IAS officers, inter alia, provides for comments on the overall quality of officers including areas of strength and his attitude towards weaker sections.
