MINISTRY OF RAILWAYS (RAIL MANTRALAYA)

No. D-43/15/2019-F(E)III

New Delhi, dated: 30.01.2020.

The General Managers / Principal Financial Advisors,
ll Zonal Railways / Production Units.

Sub : Reckoning of Charge Allowance for the purpose of revision of Pension of Pre-2016 retirees in terms of 7th CPC recommendations - reg.

Consequent upon the recommendations of 7th CPC, instructions were issued vide Board’s letters No.2016/F(E)III/1(1)/7 dated 10.08.2016 and 22.05.2017, regarding revision of pension / family pension of pre-2016 pensioners / family pensioners. A number of references have been received in this office for reckoning of Charge Allowance for the purpose of notional fixation of pay and accordingly revision of pension w.e.f. 01.01.2016.

2. The true nature of charge allowance was earlier considered by the Board and it was decided that the charge allowance, which is actually in the nature of pay restricted under FR-35. should be reckoned as 'Pay' as defined in Rule 1303(FR-9)(21) (a)(i) R-II/6th Edition and as such, it would count as pay for the purposes of pension. gratuity etc. as well as for leave encashment. Accordingly, instructions were issued vide letter No. F(E)III/94/PN1/26 dated 23.06.1995.

3. The issue has again been examined in Board keeping in view the earlier decision on charge allowance cited in para 2 above and it has been decided as follows:-
  • Since. Board had already decided to treat the charge allowance as pay restricted under FR-35 and to reckon it as emoluments for pensionary benefits vide letter dated 23.06.1995, the charge allowance may be taken into account for notional fixation of pay for the purpose of revision of pension / family pension of pre-2016 retirees w.e.f. 01.01.2016 in terms of first formulation as conveyed by Board’s letter No. 2016/F(E)III /1(1)/7 dated 22.05.2017.
  • Pay fixed in terms of Board’s letter No. PC-VII/2017/ 1/7/5/8 dated 08.08.2019 w.e f. 01.07.2017 may also be treated as emoluments in terms of Rule 49 of the Railway Services (Pension) Rules, 1993 for the purpose of fixation of pension.
  • Since, Charge Allowance may have been paid w.e.f. 01.01.2016 to 30.06.2017 at old rates which was admissible before 2016, the same may be reckoned for calculation of retirement benefits of employees who retired between the periods from 01.01.2016 to 30.06.2017.

Chance to eligible Multiple Disability (MD) ‘Divyangjan’ Level-1 candidates to correct disability option for Railway jobs

Babloo - 21:40:00
Ministry of Railways

Another chance to eligible Multiple Disability (MD) ‘Divyangjan’ Level-1 candidates to rectify disability option for Railway jobs

Eligible MD Divyangjan candidates who have filled in their Disability option incorrectly while applying can now represent to the RRC of the Zonal Railway they had opted for with proof. Option to be available from 23rd December 2019 on RRC websites

It may be recalled that Railway Recruitment Boards (RRBs) had advertised through their centralized CEN 02/18 notification for around 63000 vacant Level-1 posts in early February,2018. Consequent to the notification of the revised Divyangjan Act (RPWD Act, 2016) and orders of the Hon’ble Delhi High Court in a case filed by an organization for one of the Divyangjan categories, a corrigendum was issued on Feb 28, 2018. An extended one month window was provided to enable the Divyangjan categories included in the revised Act, including candidates with identified Multiple Disabilities (MD) to apply for the examination. Around 1.17 crore candidates including around 1.54 lakh Divyangjan appeared at the Computer based written tests. The number of vacancies reserved for Divyangjan  is over 2400, with around equal number reserved for the four Disability categories of Locomotor Disability (LD), Visually Impaired (VI), Hearing Impaired (HI), and Multiple Disability (MD). MD refers to candidates having more than one Disability among the other three Categories of LD, VI and HI.

The vacant posts notified for any Zonal Railway are being filled in as per merit position among those who have opted for that zonal Railway and have secured the minimum qualifying threshold marks and qualified in the Physical Efficiency Tests (PET) conducted by the Railway Recruitment Cells (RRC) of the respective Zonal Railways. Divyangjan candidates have not only been fully exempted from PET, but have been accorded 2 marks relaxation in minimum qualifying cut-offs as well. Their final selection, subject to Document Verification and Medical Examination, is therefore based on their merit position in the Computer Based Tests for their Disability category and Zonal Railway they had opted for.

While over 1025 Divyangjan candidates have already been finally selected and several more candidates’ cases are under verification/medical examination, it has been observed that the MD category has remained mostly unfilled in all Zonal Railways. It is a fact that this Category has been included as per the revised Act fairly recently and the CEN 02/2018 is among the earliest recruitment notifications to incorporate this Disability Category.

In this context, several Divyangjan candidates & groups have represented that due to unfamiliarity with the revised Categorisation and application protocol, they have filled in only Single Disability (either LD or VI or HI) option in the application form, instead of two or more of the Disabilities that they are affected with. Due to this inadvertent exercise of option, such candidates have therefore been considered only against the respective single Disability Category of LD or VI or HI as per option, and not as MD to which they actually belong.

The above representation has been considered in the Ministry of Railways, and it has been decided to allow a window period for such candidates to represent for considering them against MD Category vacancies. Accordingly, those eligible Divyangjan MD candidates who actually have more than one benchmark Disability among the three single Disability categories of LD, VI and HI but have inadvertently opted for only a single Disability Category in their application forms for the Level-1 CEN 02/2018 recruitment notification will now get another chance to be considered against unfilled MD Category vacancies of the Railway zone they had originally opted for. Such eligible Divyangjan MD candidates, who have a score of 38 or more in the written Computer Based Test (28 or more for Divyangjan of SC/ST/non-creamy layer OBC) will be able to represent to the RRC of the Zonal Railway they had opted for with proof of their belonging to MD Category. The notification and format for representation is scheduled to be available in the relevant RRC/RRB websites from 23rd December 2019 for around a fortnight. From amongst the eligible applications so received and scrutinised, shortlisting for further processing for filling up the unfilled MD vacancies will be done as per merit position. Indicative notice has already been published in newspapers for advance information of the eligible MD Category Divyangjan in this regard.

Indian Railways continues to remain committed to the cause of empowerment of Divyangjan and in following all applicable laws and provisions in this regard in letter and spirit. The dispensation being adopted above is an illustrative example in this regard.

Railway transfer request

Relief of the railway employees in the event of a transfer request

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(RAILWAY BOARD)

RB.No: 203/2019

No.E(NG)I/2019 /PM2/ 18CC

New Delhi, dated November 26-11-2019

The General Managers
All Zonal Railways & Production Units.
(as per srandard mailing list)

Sub: Relieving of Railway employees in time after order of transfer in cases of request transfer.

As the Railway administrations are aware, instructions already exist which provide that in cases of request transfer, the requests should be dealt with in an organized and expeditious manner so that there is no occasion for any grievance in the mind of the staff in regard to the handling of their request.

It has been observed that despite the existence of such instruction, due to administrative exigencies,it sometimes becomes difficult to relieve the transferred employee a within a reasonable time, which results in loss of seniority to the employee in his new place of posting. The loss is even greater when he goes to posts one grade below, and new recruits from subsequent batches join before him.

Also check: Comprehensive Transfer Policy – Exemption from 5 years service condition – Indian Railways – NFIR

The loss in seniority in such cases resulting from delayed relieving of the emproyee often leads to litigation, and structures passed by Hon’able Courts.

In one such case recently, the Hon’ble CAT/Chennai in OAs, No.751/2019 and other similar OAs, vide their common order dated 05.07.2019, inter-alia observed as under:

Since it is submitted by the applicants that IREC is silent on the above issue and accordingly there is a void in this regard in the policy, we deem it appropriate to direct the first respondent to consider the concerned raised in the OAs as a policy issue and take an appropriate decision on whether and if so, how the interests of such transferred employees should be protected in regard to their seniority at-least from the date from which they where approved for IRT, if they could not be relieved soon thereafter in public interest. Such policy decision may be taken and orders issued within a period of six month from the date of receipt of a copy of this order.”

The matter has accordingly been considered in the Board. while it may not be desirable / feasible to assign seniority to transferred employee of approval of in the new unit from the date of approval of the transfer, when the employees is still actually working in the parent unit, every effort should be made to relieve her/him at an early date. Where delay in relieving of the employees after orders are issued exceeds is likely to exceed 3 months, the case should be put up by Sr.DPO/ WPO to DRM/ CWM as the case may be giving specific reasons for the delay and likely date of relief.

Please acknowledge receipt.

Railway Vacancies in 7th CPC Pay Level-1 twent per cent quota reserved for Course Completed Act Apprentices

Railway Vacancies in 7th CPC Pay Level-1 twent per cent quota reserved for Course Completed Act Apprentices
No. II/94/Part I
Dated: 08/11/2019

The Member (Staff),
Railway Board,
New Delhi

Dear Sir,

Sub: 20% quota vacancies in 7th CPC Pay Level-1 reserved for "Course Completed Act Apprentices" - need for delegation of powers to GMs to fill the posts promptly - reg.

Ref:  (i) Railway Board’s reply to NFIR vide letter No. E(NG)II/2019/RR-I/5 dated 23/04/2019
(ii) NFIR’s letter vide No.II/94/Part I dated 17/08/2019 to the Member Staff, Railway Board.

Responding to Railway Board’s reply dated 23/04/2019, the Federation vide its letter dated 17/08/2019 has again conveyed to the Railway Board certain valid points with regard to fulfillment of 20% quota vacancies in GP 1800 Level-1 by Course Completed Act Apprentices of Railways.

Also check: 7th Pay Commission Pay Matrix Table Level 1 to 5

NFIR once again re-iterates the following for re-consideration :-
  • The 20% quota meant to be filled by Railways trained Act Apprentices has, in fact, not been fulfilled due to inexplicable reasons which are beyond the control of RRCs. This is causing adverse impact on the IR system as the vacancies in Level-l particularly in Safety categories of Technical Departments continued to remain unfilled while at the same time the Course Completed Act Apprentices of Railways are out of job despite the fact that they possess required skills for performing technical jobs in Railways.
  • In Workshops and Depots/Sheds, the Act Apprentices (under training) are utilized by the authorities on regular jobs during training period due to heavy shortage of manpower, with the objective of achieving out turn targets fixed by the Railway Board. The earmarked 20% quota vacancies, if allowed to be filled under GM’s powers, the trained apprentices will have job opportunities and equally their skills will be of greater advantage for Railways to improve quality and efficiency.
  • Another important factor causing negative impact on the IR system is non-consideration of Inter Railway transfer requests of Level-l safety category staff (Track Maintainers, Helpers etc.,) due to non-availability of replacement. Even the options of optees to different projects on Indian Railways are not being forwarded by the Zonal Railways despite communications from Project Organisations in view of heavy vacancy position.
  • For ensuring quality and efficiency of Railways, adequate manpower possessing required skills is the need of the hour. The field position reveals that in Depots, Sheds and Workshops the staff strength is very much inadequate and for this reason, the GMs are required to be given powers for induction of course completed act apprentices against 20% vacancies in Level-l for meeting the exigency and urgency.
NFIR, therefore, once again requests the Railway Board (MS) to kindly re-consider the matter for delegating powers to the General Managers to induct Course Completed Act Apprentices against 20% quota vacancies of Level-1 posts as laid down in RBE No. 71/2016 dated 21/06/2016 de-linking with the recruitment process of RRC. Federation may kindly be replied on action taken on this letter.

Yours faithfully,
(Dr.M.Raghavaiah)
General Secretary

The Chairman,
Railway Board,

Dear Sir.

(ii) Railway Board’s letter No. E(NG)I-2005/TR/20 dated 10/02/2017.

(viii) NFIR’s letter No. II/14/2018-I dated 22/07/2019 & 25/03/2019.

Federation brings to the kind notice of the Railway Board (CRB) that NFIR’s PNM Agenda Item No. 18/2016 relating to relaxation of service condition of minimum five years service in the case of re-employed Defence Forces Personnel seeking inter Railway transfer on request has been pending since the last three years. During NFIR’s PNM meeting held with the Railway Board on 25/26-04-2019, the Official Side conveyed through Action Taken Statement as under:-

Also check: Comprehensive transfer policy – exemption from 5 years service condition

“The matter is presently under consideration. Feedback has been called for, from all the Zonal Railways. Responses from some of them are still awaited.”

Federation feels sad to state that though a period of over six months passed, progress made into the matter is yet to be conveyed.

In this connection, Federation also brings to the notice of the Board (CRB) that the NFIR General Secretary held discussions at the level of CRB more than once (last discussions held on 22/11/2018), when the CRB gave assurance that the relaxation has been processed and the final orders would be issued very shortly, but unfortunately relaxation decision has not been issued so far.

May I once again seek the intervention of CRB to kindly see that order issued granted relaxation to five years service condition in favour of former Defence Personnel re-employed in Railways, facilitating their inter Railway transfer requests soon.

Yours faithfully,
(Dr. M.Raghavaiah)

Expected DA January 2020 – Dearness Allowance calculation’s 3rd stage is over!

Dearness Allowance calculation’s 3rd stage is over! Central Government Employees

What does Expected DA mean?

The assumption on the Dearness Allowance calculation method. Twice a year, DA is given. So, it’s going to be revised once in six months. DA will be calculated according to CPI (IW) data every month. The percentage will be listed as additional DA without decimal at the end of each June and December.

Expected DA January 2020

There is a need for six months of CPI (IW) statistical data for 2001=100 from July to December 2019 to calculate the additional DA with effect from January 2020. The Labor Office today released the press release of the CPI (IW) for the month of September and the index is increased by two points from 320 to 322. This is the third stage in the ‘Expected DA January 2020 ‘ process. The calculation for the months of July and August has already been completed.

The Secretary (E),

Dear Sir,

Subject: Restructuring of certain Group ‘C’ cadres – Artisan staff – Extension of option period for switching over to 7 CPC Pay Matrices

Ref: (i) NFIR’s PNM item No. 20/2018.
(ii) GS/NFIR’ s letter No. I/8/CRC/09/Vol.11 dated 10/10/2016 to Railway Board.
(iii) NFIR’s letter No. IV/NFIR/7 CPC (Imp)/2016/R.B.-Part II dated 11/02/2019 & 23/02/2019 addressed to DG(Pers), Railway Board.
(iv) Railway Board’s OM No. C-VII/2018/RSRP/1 dated 11/03/2019 to the Ministry of Finance.
(v) NFIR’s letter No. I/8/CRC/09/2019 dated 13/08/2019 to Railway Board.
(vi) Railway Board’s reply to GS/NFIR vide letter No. PC-VII/2018/RSRP/1 dated 27/09/2019.

On perusal of the reply of Railway Board to NFIR under reference No. PC-VII/2018/RSRP/1 dated 27/09/2019, Federation felt that the Railway Board have not analyzed this issue properly as raised by the Federation for the purpose of impressing upon the Ministry of Finance, the need for extending re-option opportunity to the Railway employees who have been promoted subsequent to the date of notification i.e. 28th July, 2016. For proper appreciation, NFIR reiterates its contentions as below :-

Read this: 7th Pay Commission Pay Fixation : 7th CPC Pay Fixation with examples

  •     Firstly, the subject relating to extension of option period for switching over to 7th CPC Pay Matrices was tabled by NFIR in the PNM fora under Item No. 20/2018 and the issue is still pending as further discussions are yet to take place.
  •     The issue was also raised by JCM (Staff Side)/Leader in the National Council JCM meeting held on 13th April, 2019 at Rail Bhavan under the Chairmanship of Cabinet Secretary. In this connection, attention is invited to Para 4.5 of the minutes of 47th meeting of NC/JCM circulated vide DoP&T O.M. dated 13th June, 2019, the same may be connected.
  •     Attention is also invited to minutes of the Standing Committee Meeting of NC/JCM held on 7th March, 2019 wherein the Chairman desired that the Department of Expenditure may consider the demand of the Staff Side. The JCM (Staff Side) as well the Federation is awaiting for the final outcome of the discussions held on 7th March, 2019.
  •     In the NFIR PNM Agenda, the Federation has cited the specific case of promotions granted under cadre restructuring w.e.f 01-09-2016 to the Technicians category on Indian Railways and contended that all those staff who came up for promotion w.e.f. September 1, 2016, are entitled for option opportunity to switch over to 7th CPC pay matrices after getting their promotion implemented in the VIth CPC Pay Band if they wish. The Federation has further amplified its contention, stating that 90 days time was given from the date of notification to enable the employees to opt for 7th CPC pay matrices and the said 90 days period ended only on 28th October 2016, whereas the Technicians got promoted w.e.f. 01-09-2016 under cadre restructuring. pointing out this specific case, NFIR they got promoted during this intervening period. This practical situation emerged in Railways could have been explained in detail by the Railway Ministry to the Finance Ministry for rendering justice.
  •     Federation vide its letter dated 11-02-2019 clearly brought out the relevancy of Rule 5 & 6 of RS(RP) Rules 2016 of Ministry of Railways Notification dated 28th July,2016 and Ministry of Finance Notification dated 25th July,2016 in the instant case, therefore it would be unfair to take a negative view for rejecting the legitimate right of the Railway employees. Federation finds that its letter dated 11-02-2019 perhaps has not been connected in Railway Board’s Office while taking up the matter at the level of Ministry of Finance as the Railway Board’s O.M. dated 11-03-2019 to Ministry of Finance, (Department of Expenditure) has not adequately projected the merits as well Railways case.

Summing up, NFIR urges upon the Railway Board to kindly review the case realistically and support NFIR’s genuine demand, duly making out cogent proposal to Ministry of Finance for extending the re-option opportunity not only to the affected employees in the Railways but also to others. Federation also conveys that it is pained to take note the Railway Board’s perception as mentioned in the last sentence of the reply stating “it is a closed chapter”.

Federation vide its communications dated 07/09/2018 & 11/02/2019 brought to the notice of Railway Board a specific case of wrong fixation of pay in favour of Shri Satyendra Kumar Lal, Chief Typist, DLW, Varanasi. Reckoning Grade Pay Rs.4200/- Level 6 of 7th CPC Pay Matrix as entry Grade Pay for granting financial upgradation under MACPS to the Station Master category in Railways

Babloo - 09:23:00

NFIR

Reckoning Grade Pay Rs.4200/- Level 6 of 7th CPC Pay Matrix as entry Grade Pay for granting financial upgradation under MACPS to the Station Master category in Railways.

No. IV//MACPS/ 09/2019
Dated: 09/09/2019
The Secretary (E),
Railway Board,
New Delhi

Dear Sir,
Sub: Reckoning Grade Pay Rs.4200/- Level 6 of 7th CPC Pay Matrix as entry Grade Pay for granting financial upgradation under MACPS to the Station Master category in Railways - reg.

Federation feels disappointed that despite the above subject was listed in the PNM Agenda two years ago, there has been no decision from Railway Board till date.

Vide NFIR's letter of even no. dated 09/04/2019, merits of the case have been adequately explained besides extract of Item No. 31 of Railway Board's letter PC-V/99/1/1/1 dated 19/02/2002 has also been furnished. In terms of item No. 31 of Board's letter dated 19/02/2002, the Station Masters are entitled for 3rd financial upgradation under MACPS in GP 5400/ Level-9 (7th CPC). In this connection, Railway Board's letter No. PC- V/2019/ CC/7/WCR dated 05/04/2019 addressed to General Manager (P), W.C. Railway, Jabalpur allowing 3rd financial upgradation in terms of Board's letter dated 19th February,2002 (para 1.4) may be connected. It is however unfortunate that although the case of Station Master category gets covered by Railway Board's letter dated 19th February, 2002 for the purpose of entitlement of 3rd financial upgradation (GP 5400/Level-9) under MACPS, the Railway Board have not responded to Federation's PNM Item No. 15/2017 even after lapse of two years.

Attention is also invited to 7th CPC recommendation contained in para 11.40.55 of the report, relevant extract of which is placed below:-

"Keeping in mind the identical educational qualifications required for the posts of ASM and SM, with practically no difference in the functions performed by .them, and the historical importance of the post, it is recommended that the ASMs in GP 2800 should first be upgraded to GP 4200 and then fitted in the revised Pay Matrix. The cadre will then have 60 percent posts in Level 60 and 40 percent in Level 7. The designation of ASM may be abolished".

Federation once again urges upon the Railway Board to expedite action and decision, granting 3rd financial upgradation under MACPS to Station Master category in GP 5400/ Level-9.
Yours faithfully,
(Dr. M. Raghavaiah).

An attempt has been made to bring the main elements of these instructions together in one document. However, this is only to improve clarity and understanding. This summary has to be read with all relevant instructions already issued on the subject.

4. Criteria for review of Services:

a) Age and Service rendered:

1) Group A and B:After attaining 50 years (if entered service before age 35);

27.08.1969 incorporated as para 620 of Manual of Railway Pension Rules, 1 950.)

b) Service Records:

The entire service records should be considered in every review. Based on the service records, a comprehensive brief is to be prepared for consideration of the ‘Review Committee’. ‘Service records’ would take into account the following:

1) ACR/APAR dossiers;
2) Personal file;
3) Work and performance of the officer to be assessed by looking into the files dealt with by hi m or i n any papers or reports prepared and submitted by him;

5) If the officer was promoted during the last 5 years (on the basis of seniority-cum-fitness and not on the basis of merit), the previous entries in the ACRs may be taken into account.
( Reference: E(P&A) l-201 5/RT/38 dated 10/12.11.2015)

c) Ground of Ineffectiveness vis-a-vis Doubtful Integrity:

3) No employee should be ordinarily retired on ground of ineffectiveness, if in any event, he/she would be retiring on superannuation with in a period of one year from the date of consideration of his/her case. However, if there is a ‘sudden and steep fall in competence, efficiency or effectiveness of an officer’, it would be open to review his case for premature retirement. This condition is not relevant in cases of doubtful integrity.
(Reference: E(P&A)I-20 15/RT/38 dated 10/ 12.11.2015)

d) Integrity

1 ) Actions or decision taken by the employee which do not appear to be above board, complaints received against him or suspicious property transactions, for which there may not be sufficient evidence to initiate departmental proceedings, may be taken into account for prematurely retiring an employee.
(Reference: Observations of Supreme Court in S. Ramachandra Raju Vs. State of Orissa and K. Kandaswamy vs UoI, cited in E(P&A)l-201 5/RT/38 dated 10/12.1 1.2015)

(Ref: E(P&A)J-20 I 5/RT-38 dated 10/12.11.2015)

e) Conduct unbecoming of a Government Servant as basis for Compulsory Retirement:

If conduct of a government employee becomes unbecoming to the public interest or obstructs the efficiency in public services, the government has an absolute right to compulsorily retire such an employee in public interest.
(Reference: Observation of Supreme Court i n State of U P and others vs. Vijay Kumar Jain, appeal case, cited in E(P&A) I-20 1 5/RT/38 dated 10/12.11.2015.)

(ii) The confidential reports/ files of officers whose confidential reports are not maintained in Board’s office and whose cases are to be reviewed should be brought up to date in all respects and sent to Secretary Railway Board along with the above list through a responsible member of the staff. Half yearly time table has been prescribed for the same. (This has been revised to quarterly vide DoP&T’s circular dated 21.03.2014 mentioned at para 2 above.) f) Complete bio-data particulars of the employee who is to be reviewed should be circulated to the members of the Review/ Representation Committees as per the prescribed proforma (Annexure-I to this letter). Findings of Review/ Representation Committees/SDGMs in ‘doubtful integrity ‘ cases should be entered in the proforma itself.

g) Rule relating to premature retirement should not be used:

(i) To retire on ground of specific misconduct as a short-cut to initiating formal disciplinary proceed ings. (CAT/PB/New Delhi i n 0.A No. 1827/201 7, i n the matter of Sangeeta Rao vs. UOI vide order dated 18.09.2018, dismissed the plea of the government servant who was compulsorily retired under 56(J) for habitual late coming); or

(ii) For reduction of surplus staff on ground of effecting general economy without following rules of retrenchment.

h) Any adverse entries made in the confidential record shall be taken note of and be given due weightage in passing such order.

i) Even un-communicated entries in the confidential record can also be taken into consideration.

j) If the officer was given a promotion despite adverse entries made in the confidential record, that is a fact in favour of the officer. (Ref: ( Reference: E( P&A)l-2015/RT/38 dated 10/12.11.2015)

k) Once a decision has been taken by appropriate authority to retain an employee beyond the age of 50 years after review, he would ordinarily continue in service till he attains the age of retirement. If however, the appropriate authority considers at any time after review that retention would not be in public interest, that authority may take necessary action to retire as per the laid down procedure.

l) If the ‘appropriate authority ‘decides to differ with the recommendation of the Review Committee, he may remit the papers to the next higher authority for a final decision.

m) A notice longer than 3 months can be given, but the date from which he is required to retire as specified in the notice should not be before he attains the age of 50/55 years or before be completes 30 years of service.

Dear Sir,
Sub: Retired Employees Liberalized Health Scheme (RELHS-97) - reg.

Ref: Railway Board's letter No. 2011/H/28/1/RELHS/Court Case dated 31/05/2012.

Kind attention of Railway Board is invited to the instructions issued vide Board's letter dated 31/05/2012 wherein the Railway Board had decided to allow pre-March 2009 retirees to be members of the RELHS-97 and also for post March 2009 onwards, the retirees shall be the Members of the Scheme. The Railway Board while allowing pre-March 2009 retirees the RELHS-97 Membership without any time limit, had imposed restriction of one year for March, 2009 onwards retirees to become Members of the Scheme.

Instances have been brought to the notice of the Federation by our affiliated Unions that on many Zonal Railways/PUs there are good number of retired Railway employees or their dependent family members belonging to the period post March 2009 and upto 3110512012 who could not avail the opportunity during the one year period, are now requesting to joining the Scheme. These retired employees or their dependent families have been living in rural areas and were unaware of the provision for joining RELHS-97 at that point of time. Some of our affiliated Unions took up the issue aI Zonal level in the PNM forum where the same has been pending for more than two years due to the reason that decision on this subject is required to be given by the Railway Board. Federation feels that the Railway Board would appreciate the circumstances under which the retired employees could not join the Scheme when opportunity was provided.

NFIR, therefore, requests the Railway Board to kindly consider the above points and issue modified instructions to enable the retired employees/ widows who retired during the period March, 2009 upto 31/05/2012 to join as members of RELHS-97 without any time limit. A copy of the instructions issued may be endorsed to the Federation.
Yours faithfully,
(Dr. M. Raghavaiah)

Sub: Fixation of pay of the employees who got promoted to the post of higher Pay level after being granted the benefit of pay fixation on grant of financial upgradation under MACPS.

The issue regarding regulation of pay fixation when the promotion to a higher pay level takes place in the 7th CPC period after the employee has already availed the benefit of pay fixation on grant of Financial Upgradation under MACPS has been under consideration for quite some time. It has been decided in consultation with DoP&T that the pay fixation benefit on grant of MACP after 7th CPC may be regulated in the following manner:-
(i) Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme (as prescribed in Para 13 of RS(Revised Pay) Rules, 2016).

(ii) There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same pay level as granted under MACPS.

(iii) However, at the time of actual promotion if it happens to be in a post carrying higher pay level than what is available under MACPS, then he shall be placed in the level to which he is promoted-at a cell in the promoted level equal to the figure being drawn by him on account of MACP. If no such cell is available in the level to which promoted, he shall be placed at the next higher cell in that level. The employee may have an option to get this fixation done either on the date of promotion or w.e.f. the date of next increment as per the option to be exercised by him.
2. This has the approval of the Finance Directorate of Ministry of Railways.
