2. Board's letter No. PC-VI/2010/I/5/1 dated 10.04.2018 (RBE No. 56/2018)
3. Board's letter No. 2013/Sec(E)/PA-2112 (CC) dated 03.11.2017 to Chief Security Commissioner/ RPF/ Western Railway (copy enclosed).

Vide Board's letter dated 10.04.2018 (RBE No.56/2018) higher grade pay of Rs. 2000/- was made applicable to all the Drivers Gr. III (Constable) of RPF/RPSF only who are similarly placed as compared to the petitioners in W.P. No. 15763/2013.

In this connection, a reference was received seeking clarification as to whether direct recruited Driver Gr.III of RPF/RPSF {who were enlisted in service as Driver Gr. III on 15.07.2010 in the pay scale of Rs. 5200-20200 + GP Rs. 1900/-) are to be treated at par with the petitioners of Writ Petition No. 15763/2013 (Shri Valibhai Y Darvodiya & 17 Ors Vs CSC/ RPF, CCG/ Mumbai and DC /RPF) for the purpose of granting {higher grade pay of Rs. 2000/-.

The matter has been examined in depth and it is accordingly clarified that all the Drivers Gr.III of RPF/ RPSF are to be considered similarly situated as the petitioners in W.P.No. 15763/2013 for grant of higher grade pay of Rs. 200/-.

4. Further, the recruitment at the revised upgraded pay in future will be made after duly incorporating the revised pay in the relevant Recruitment Rules.

This issues with the concurrence of Finance Directorate of this Ministry.

Two very important issues, being persuaded by AIRF at the Railway Board level, have been resolved, one is -1S grade, which had been abolished by the VII CPC, has been restored, and the other issue regarding mutual transfer from one railway to other will be treated as inter-division transfer and need not to take NOC from the Zonal Railway Headquarters. Divisions at their own level will issue NOC, lot of time consumed for this purpose will be saved.

Comrades! Today I met the Cabinet Secretary (Government of India) and raised the issue of "Very Good" benchmark along with other issues of National Pension System (NPS), Minimum Wage and Fitment Formula and non-holding of JCM Meetings.

The Cabinet Secretary's views were positive and he stated that he has already communicated to Chairman Railway Board and Secretary (DoP&T) that benchmark for MACPS cannot be more than the benchmark prevalent for promotion/ selection.

He also stated that the issue of National Pension System (NPS) is under active consideration of the Government of India and he will try to derive the best formula to resolve the problems arrived out of NPS.

OFFICE MEMORANDUM

Subject:  Filling up of the post of Member, Staff Selection Commission, New Delhi (Joint Secretary level) in the pay scale PB-4, Rs.37,400-67,000/-  plus Grade Pay Rs. 10,000/- (pre-revised) on deputation basis.

It is proposed to fill up the post of Member, Staff Selection Commission (SSC) in the Staff Selection Commission (Hqrs) at New Delhi in the Pay Scale PB-4 Rs. 37,400-67,000/- plus Grade Pay Rs. 10,000/- (pre-revised). The eligibility criterion is given in Annexure-I.

2. Application of only such officers will be considered as are routed through proper channel and are accompanied with (i) bio-data in the proforma at Annexure-II;  (ii) clear photocopies of the up-to-date APAR dossier of the officer containing APARs. of at least last five years, duly attested by a Group 'A' officer (if original APAR could not be sent); (iii) An attested Statement indicating the grading in the APAR during the last five years (iv) cadre clearance; (v) clearance from vigilance and disciplinary angle; and (vi) statement giving details of major or minor penalties, if any, imposed on the officer during the last ten years.

3. All Ministries/Departments and the State Governments/UTs are requested to forward the applications of willing and eligible officer in the prescribed proforma to :
Shri Ej. Selvalcumar, Section Officer (Estt-B), Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Room. No. 215-C, North Block, New Delhi-110001, so as to reach this Office, on or before 27th  December, 2016.

4. The applications of only those officers may be forwarded who, in the event of  their selection, would immediately join the duties of the post, and whom the  concerned authorities would be in a position to relieve immediately. The application once forwarded would not be allowed to be withdrawn. Applications received after the prescribed date or not accompanied with the required certificates/documents will not be entertained.

Eligibility Criterion for the post of Member, Staff Selection Commission, New Delhi.

1. Name of Post : Member, Staff Selection Commission, New Delhi.
2. Scale of pay : PB-4, Rs. 37,400-67,000 + Grade Pay of Rs. 10,000/- (pre- revised).
3. Eligibility: Officers of the Central Government (including officers of All India.
Services and Central Group 'A' Services).

(a) (i) Holding analogous posts on regular basis in the parent cadre/Department;
or
(ii) with five years service in the grade rendered after appointment thereto on a regular basis in the scale of PB-4, Rs. 37,400-67,000/- with Grade Pay of Rs. 8700/- (pre-revised) or equivalent in the parent cadre or Department; and

(b) Possessing the following educational qualifications and experience:-
(i) Post Graduate Degree in any discipline from a recognized University or Institution.
(ii) 10 years experience in dealing with Service, Administrative, Vigilance, Establishment and Financial matters.

4. Period of Deputation:  The upper age limit at the time of appointment to the post of Member of Staff Selection Commission will be 59 years and he/she shall hold office for a period of five years or till he/she attains the age of 62 years, whichever is earlier, provided that in case a serving officer appointed as Member, Staff Selection Commission retires on superannuation before completing the tenure of five years, he/she shall be deemed to be on re-employment for the remaining period of tenure subject to the upper age limit of 62 years.

5. Age Limit: The maximum age limit for appointment by deputation shall not be exceeding 59 years as on the closing date of the receipt of applications.

OFFICE MEMORANDUM

Subject: Revision of pay of employees stagnating at the maximum of the Pay Band and Grade Pay or scale in pre-revised structure under Central Civil Services (Revised Pay) Rules, 2016.

The undersigned is directed to say that consequent upon notification of Central Civil Services (Revised Pay) Rules, 2016, representations have been received regarding provision of additional increments in the revised pay structure on 01.01.2016 in case of employees who had been stagnating at the maximum of the Pay Band and Grade Pay or scale in the pre-revised pay structure.

2. The matter was examined in this Department and it has been decided that in case of persons who had been drawing maximum of the applicable Pay Band and Grade Pay or scale, as the case may be, for more than two years as on 01.01.2016, one increment in the applicable Level in the Pay Matrix shall be granted on 01.01.2016 for every two completed years of stagnation at the maximum of the said Pay Band and Grade Pay or scale. Grant of additional increment (s) shall be subject to condition that the pay arrived at after grant of such increment does not exceed the maximum of the applicable Level in the Pay Matrix. Illustrations:

Subject: Agitation Programme from 13.06.2016 to 18.06.2016.

Government Employees National Confederation has decided that all the constituent Federations of GENC will observe an agitation programme throughout the country from 13.06.2016 to 18.06.2016.

Being a constituent of GENC this federation BPMS has decided that all the affiliated unions will organize agitation programme from 13.06.2016 to 18.06.2016 like Gate Meeting, wearing black badges, slogan shouting, Dharna etc. On the last day of demand week a memorandum would be submitted to the respective Head of establishments addressing Hon’ble Prime Minister of India.

The demands are as follows :

1. Minimum Pay should be fixed 24000/- rupees in place of 18000/-;
2. The fitment formula should be 3.42 in place of 2.57 ;
3. The ratio of minimum Pay and maximum Pay should be 1:10 ;
4. Annual increment should be 5% in place of 3% ;
5. Five financial upgradation should be granted within the period of 30 years of Service under MACP scheme ;
6. Pay Scales of Group ‘C’ employees should be merged and upgraded. Grade Pay 1900 and Grade Pay 2000 should be merged and upgraded to 2400 and Grade Pay 2400 and Grade Pay 2800 should be merged and upgraded to Grade Pay 2800 ;
7. Risk Allowance, Washing Allowance, Family Planning Allowance should be continued ;
8. HRA should be granted at the rate of 15%, 25% and 35% ;
9. Minimum two increments should be granted at Promotion ;
10.Interest free Advances should be continued ;
11.OTA is being granted to the employees posted in offices, directorates etc at the rate of 12 rupees per hour (on the pay scales of 4th CPC). OTA should be granted on the Pay Scales of 7th CPC ;
12.Old Pension Scheme should be restored in place of NPS ;
13.The employees covered under NPS scheme should be benefited with gratuity ;
14.Commuted Pension should be restored on year in place of 15th year :
15.CCL related to women employees should not be reduced ;
16.There should not be any educational criteria (High School passed) for grant of compassionate ground appointment ;
17.Benefits of 7th CPC should be granted to Centre, State and autonomous body employees equally ;
18.Since amendment in Bonus Act has retrospective effect and implemented since 2014, the arrear of 2014-2015 should be granted without any delay ;
19.All the employees should be granted Night Duty Allowance without any ceiling ;
20.In Ordnance Factories all Piece work employees should be paid OTA (Between 44¾ and 48 hours) on their actual Pay instead of minimum Pay ;
21.The employees having equal qualification and same nature of work should be granted equal pay in all ministries ;
22.Examiners working in Quality control department in OFB should be granted Incentive Bonus ;
23.According to 7th CPC recommendations, civilian employees retiring on same Post or same pay scale should be granted equal Pension ;
24.Wards of employees died in harness are unable to find a Job due to 5% ceiling in compassionate appointment. Therefore, waiting dependants should be granted one time relaxation in compassionate appointment ;
25.The employees of DRDO should be granted the benefit of PRIS ;
26.Trade Apprentices should be taken in job in their respective establishments according to their batch wise seniority.

Sub: VII Central Pay Commission recommendations - Submission to the empowered Committee Secretaries- reg.

1. Bharat Pensioners Samaj(BPS) Federation of pensioners’ associations, a conglomerate of over 628 pensioners’ organizations as an accredited Federation under the Government of India, had appealed to the Secretary, Ministry of personnel, Public Grievances and Pensions, on 16.2.2016 during the meeting on Aadhar seeding to hold a meeting of Pensioners Associations to discuss 7th CPS pension related recommendations, though he had agreed to hold such a meeting but it did not materialize.

2. Now BPS has come to know through NJCA News letter dated 27.5.2016 issued after their meeting with you on 26.5.2016that the Department of Pension is opposed to the first option recommended by the 7th CPC to bring about the parity with the past pensioners, as they consider it to be infeasible and impracticable (due to the non-availability of the requisite records)

3. It is hard to believe, how a department meant for the welfare of pensioners which helped pensioners to get better deal in earlier pay commissions could arrive at such a damaging and misleading decision without even consulting the stake holders.

4. Sir, Service record is a permanent one and if it to be destroyed, proper permission from the Competent Authority is to be obtained. In any case, service record of pensioners can always be reconstructed taking the details from various sources available with the department and the material collected from the Pensioner. This has been done in the past while implementing parity enunciated by fifth CPC and even while implementing modified parity of 6th CPC. It is also being done now implementing OROP. In this regard Your kind attention is also drawn to recent Bombay High court Nagpur judgement dated 09.03.2015 in case of Smt. Saija v. General Manager, Central Railway O.A.No. 2131 of 2011 (Bombay Bench at Nagpur)
Undersigned in the capacity of Secy. Genl ‘Bharat Pensioners Samaj’ request you to takean independent decision in view of submission in Para 4 above to save pensioners/family pensioners from unprecedented permanent damage by a department meant for their welfare.
