Sub: Appointment on compassionate grounds - Relaxation in upper age limit regarding.

Attention is invited to para IX (Authority competent to make appointments on compassionate grounds) and para VI(a) (Qualification and conditions to be fulfilled) Board’s letter dated 12.12.1990 which lays down that normally the persons seeking appointment on compassionate grounds should fulfil the conditions of eligibility regarding age and educational qualifications prescribed for appointment to the posts or grade concerned. However, the upper age limit may be freely relaxed on merits of the cases.

The lower age limit of 18 years normally required for appointment in Government may also be relaxed upto one year with the personal approval of the General Manager. Relaxation of the lower age limit beyond one year will require the approval of the Ministry of Railways. In making appointments on compassionate grounds, Divisional Railway Managers may relax age limit in the case of appointment to Group 'D' posts.

The issue of delegation of power to DRM/CWM regarding relaxation of upper age limit in making compassionate grounds appointment was under consideration in this office. It has now been decided by the Board that wherever DRM/CWM is competent to make the appointment on compassionate grounds, they may grant relaxation in upper age limit also.

Sub: Direct recruitment from open market in Level-1 (7th CPC pay matrix) - Procedure-regarding.

The non-materialization of full panel despite all out efforts made by the Railway recruiting agencies has been engaging the attention of the Board. Accordingly, the procedure for recruitment from open market in Level-1 was reviewed and following decisions taken with respect to different instructions issued from time to time:-

i) Para I (ii) of instructions contained under RBE No. 138/2014 dated 10.12.2014 lays down that "the number of candidates called for Physical Efficiency Test (PET) should be 02 (two) times the number vacancies".

In modification of above, the number of candidates to be called for PET should now be 03 (three) times the number notified vacancies.

ii) Para 3 of instructions contained in RBE No. 73/2008 dated 17.06.2008 lays down that "the number of candidates called for Document Verification (DV) shall be 20% over & above the number of vacancies".
In modification of above, henceforth, the number of candidates to be called for DV shall be twice the number of notified vacancies.

iii) Para 2 of instructions contained in RBE No. 06/2014 dated 10.01.2014 stipulates that "no replacement panels are to be given against non-joining of selected candidates".

In modification of the above, it has been decided that the panel will now be formed to the extent of the notified vacancies with a standby panel of 50% of the notified vacancies. In case the main panel plus stand-by is also exhausted and still there is a shortfall vis-a-vis notified vacancies, the recruiting agency may further go down in the list of candidates which meet the requirement of minimum qualifying marks in their respective community for conducting PET(If needed) and DV/ME to the extent of shortfall community-wise. This may be done till the demand from the concerned Railway administration w.r.t indent placed and vacancies notified is fully met. These provisions shall be subject to currency of the panel.

2. The above guidelines will also be applicable to recruitment notification published under centralized Employment Notice No. 02/2018, issued by Railway Recruitment Boards.

Subject : Grant of Advances - Seventh Central Pay Commission recommendations - Amendment to rules on House Building Advance (HBA) to Railway servants.

Please refer to this Ministry’s letter of even number dated 05.12.2017 on the above cited subject,vide which, the revised rules relating to the grant of House Building Advance (HBA) as issued by Ministry of Housing & Urban Affairs (Housing-III Section) vide their OM No.I.17011/11(4)/ 2016-H-III dated 09.11.2017 pursuant to acceptance of 7th CPC recommendations, were mutatis-mutandis made applicable to Railway employees.

2. Further clarifications were issued vide this Ministry's letter of even number dated 28.03.2018 and 27.04.2018.

3. Ministry of Housing & Urban Affairs vide their OM dated 29.06.2018 have now issued instructions regarding applicability of rules contained in their OM dated 09.11.2017 with effect from 01.01.2016 and enhancement of House Building Advance (HBA) in those cases which were sanctioned on or after 01.01.2016 but before 09.11.2017 and these are subject to conditions mentioned in their letter of 29.06.2018. A copy of the same is sent herewith, which shall be applicable mutatis-mutandis on the Railways.

According to the record note of discussions dated 12th July, 2017, the existing staff working in the cadres of ECRCs and Commercial Clerks/Inspectors may be merged with the option to interchange them. This indicates that those opt for interchange will be posted according to their option. Yesterday, CRMS contacted the undersigned on phone and I clarified on the doubt.

Sub: Record Note of Discussions held on 12th July 2017 at 15:00 hrs in the Chamber of AM (Staff) with both the Federations viz., AIRF and NFIR on the issue of:
(a) Change in staffing pattern of ASMs (G.P. Rs. 4200) in view of 7th CPC recommendations, and
(b) Change in’ staffing Pattern of TC, CC & ECRC consequent to abolition/upgradation and merger of categories in view of 7th CPC recommendations.
Ref: Railway Board's letter No. E(NG)I-2016/PM1/12 dated 20/07/2017.
With reference to the record note of discussions, it is suggested that under the heading "NFIR" the name of the General Secretary be printed correctly.
Vide Para 4 of the enclosure to Board's letter No. E(NG)I-2016/PM1/12 dated 20/07/2017, the Board sought suggestions on both the issues - (a) & (b) above.
Accordingly, the Federation gives its suggestions as below:-
Station Masters' category:
The DR quota should be limited to 50%, considering the fact that LDCE being held applying norms prescribed for DR Quota through which cream among the qualified candidates also would become Station Masters’ (GP 4200/Pay Level 6).
The Promotion quota shall be 35% to be filled by those staff mentioned in the Board's proposal upto the age of 50 years. Those in GP 1800/Pay Level 1 also be made eligible for Promotion quota, however, panel needs to be drawn in the order of seniority among the qualified staff (not to be treated as General Selection).

Commercial:
The Federation confirms the contents of Para 3(a) (b) (c) & (d) while maintaining its stand that the Ticket Checking category should as a whole, remain as separate category.
With regard to Para 3, there are precedents wherein the recommendations of previous Pay Commissions accepted by the Government have not been adopted by the Railway Ministry on the ground that Railways working is different. Example:- when the Government had accepted 5th CPC recommendation for classifying the posts in Pay Scale maximum of which was 9000 or above as "Group B", the Railway Ministry had taken a view that the said decision was not implementable and accordingly not adopted.


Record Note of Discussions held on 12th  July  2o17 at 15:00 hrs.. in the Chamber of AM (Staff) with both the Federations, viz., AIRF and NFIR on the issue of :

(a) Change in staffing pattern of ASMs (C.P.Rs: 4200) in view of 7th CPC recommendations, and;

(b) Change in staffing Pattern of TC, CC & ECRC consequent to abolition/upgradation and merger of categories in view of 7th CPC recommendations.The following officers and representatives of Federations (AIRF & NFIR) attended the meeting-:



2.Points emerged/observations made on the issue of Change in staffing Points emerged/observations made on the issue of Change in staffing pattern of ASMs (G.P.Rs.42oo) in view of 7th CPC recommendations :

(a) Federations suggested that DR Quota for Station Master should be 50% with the provision that 50% of DR vacancies can be earmarked for GDCE. Federations were advised of the merit of existing 60% DR quota and its applicability.

(b) Federations suggested that LDCE quota should be 15%.

(c) Federations suggested that General Selection Quota should be 35%;

(d) A decision has to be taken whether erstwhile G.P. Rs. 1800 should be included as eligible for LDCE and General Selection for the post of SMs or not.

(e) There was also a demand that age limit should be 50 years for all irrespective of whether candidates were General, SC/ST or OBC. The existing IREM provision contained in para 122 and implication of amending the same was advised to Federations.

3. Points emerged/observations made on the issue of Change in staffing Pattern of TC, CC & ECRC consequent to abolition/upgradation and merger of categories in view of 7th CPC recommendations; however the point needs attention as to whether we are competent to change the recommendations of 7th CPC suo- motu;

(a) The existing staff  working  in the cadres ECRCs and commercial Clerks/inspector may be merged with the option to inter-change them;

(b) Ticket Checking category as a whole should continue as separate category for the present.

(c) The merger of TC, ECRC and CC may be only for future recruits from prospective effect for which modalities be discussed;

(d) 10 +2 qualification proposed for TC and CC should not be insisted for existing staff, who do not have this qualification.

4. Both the Federations will revert back with their suggestions on both the issues.

Two very important issues, being persuaded by AIRF at the Railway Board level, have been resolved, one is -1S grade, which had been abolished by the VII CPC, has been restored, and the other issue regarding mutual transfer from one railway to other will be treated as inter-division transfer and need not to take NOC from the Zonal Railway Headquarters. Divisions at their own level will issue NOC, lot of time consumed for this purpose will be saved.

Comrades! Today I met the Cabinet Secretary (Government of India) and raised the issue of "Very Good" benchmark along with other issues of National Pension System (NPS), Minimum Wage and Fitment Formula and non-holding of JCM Meetings.

The Cabinet Secretary's views were positive and he stated that he has already communicated to Chairman Railway Board and Secretary (DoP&T) that benchmark for MACPS cannot be more than the benchmark prevalent for promotion/ selection.

He also stated that the issue of National Pension System (NPS) is under active consideration of the Government of India and he will try to derive the best formula to resolve the problems arrived out of NPS.

Please refer to our discussion held in the chamber of AM(Staff), Railway Board, on the above subject matter on 4th August, 2017. All India Railwaymen's Federation(AIRF) has already explained in detail its viewpoint in respect of calculation formula for payment of PLB to Railwaymen.

You may recall that, PLB has been an outcome of the bilateral agreement between Ministry of Railways and Staff Side Federations, which was arrived at on 22.11.1979. The formula for calculation of PLB, that was formulated as a result of above-mentioned agreement, is sacrosanct, on the basis of which payment of PLB is being made to entitled railway employees every year till last financial year.

AIRF is totally against any deviation in the well settled formula devised to calculate PLB payable to railway employees under the said agreement.

It is, therefore, urged that, payment of PLB for financial year 2016-17 should be made on the basis of established formula as mentioned above and there should not be any effort to make any amendment in the same as also number of days, calculated last year for payment of PLB, should not be reduced, else this will lead to unwarranted impairment in industrial peace.

Sub:- Recommendations of 7th CPC on benchmark for the purpose of MACPS - clarification reg.

The undersigned is directed to refer to NFIR's letter No.IV/MACPS/09/Part 10, dt. 23.01.2017 and AIRF's letter No.AIRF/MACPS (848), dt. 17.03.2017 on the above subject.The matter has been consulted with DoPT, the nodal department of Govt. on the subject and DoPT have stated that 7th CPC in para 5.1.45 of its report recommended that the benchmark, in the interest of improving performance level, be enhanced from 'Good' to 'Very Good'. In addition, introduction of more stringent criteria such as clearing of departmental examinations or mandatory training before grant of MACP can also be considered by the Government. This recommendation of the Pay Commission has been accepted by the Cabinet. Hence, withdrawal of DoPT's OM dt. 28.09.2016 is not feasible.

As DoPT is nodal department of Govt. for the purpose of MACPS, this Ministry is not in position to deviate from the instructions issued by them.

Sub:- Meeting of Departmental Anomaly Committee to settle the anomalies arising out of the implementation of 7th CPC

I am directed to bring to your kind attention that Departmental Anomaly Committee for Railways consisting of representatives of official side and the staff side to settle the anomalies arising out Of the 7th Central Pay Commission's recommendations was constituted vide Railway Board’s letter dated 5.10.2016.
Subsequently, the definition of anomaly has also been modified vide Board's letter dated 29.03.2016.

2. Now, it is proposed hold the first meeting of the Departmental Anomaly Committee to discuss the various anomalies arising out of the implementation of 7th CPC's recommendations, It is requested to advice a convenient date of time for holding the meeting along with the tentative agenda/anomalies coming within the definition of anomaly already circulated vide Railway Board's letter dated 29.032016 to be discussed in the said meeting.

On receipt of the suggestions the final agenda and the schedule of the meeting will be advised.

7th CPC Allowance Committee Report - Minister once again replied in Parliament on 22.3.2017

DoPT Minister replied in Lok Sabha on 22nd March 2017 regarding the status of the Committee on Allowances.

Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister's Office Shri DR. JITENDRA SINGH said in a written reply to various questions regarding the report of allowance committee in Parliament on 22.3.2017 as follows:

“Several representations have been received from various employees’ associations on allowances by the Committee on Allowances. Joint Consultative Machinery (JCM) has also requested to resolve the pending issues including allowances as soon as possible.

To examine the recommendations of the 7th Central Pay Commission on Allowances (other than Dearness Allowance), a Committee of Secretaries under the Chairmanship of Finance Secretary and Secretary, Expenditure has been set up by the Ministry of Finance, Department of Expenditure on 22.07.2016.
In the 13 meetings held so far, the Committee has interacted with National Council (Staff Side), Joint Consultative Machinery (JCM) and the representatives of All India Railwaymen Federation (AIRF), National Federation of Indian Railwaymen (NFIR), All India Train Controllers Association (AITCA), All India Guards Council (AIGC), Federation of National Postal Organization, National Federation of Postal Employees, Bhartiya Postal Employees Federation, Bhartiya Postal Employees Association (Group-C), Joint Action Council of Service Doctors Organization (JACSDO), All India GDMO Association (AIGDMOA), Delhi Administration Doctors Welfare Association (DADWA), Faculty Association (Maulana Azad Medical College and associated hospitals), Faculty Welfare Association (Lady Hardinge Medical College), Safdarjung Hospital Medical Officers Association, All India Government Nurses Federation (AIGNF), Railway Nurses of India, All India ESIC Nurses Federation, PGI Nurses Welfare Association, Trained Nurses Association of India (TNAI), National Federation of Atomic Energy (NFAEE).

The Committee has not yet submitted its report to the Government. Decisions on implementing the Report will be taken after the Report is submitted by the Committee.

Sub: Meeting with Hon'ble Minister for Railways
Today I met Hon'ble Minister for Railways, Shri Suresh Prabhakar Prabhu and handed him over a copy of our Protest Letter, No.AIRF/24(C) dated February 2, 2017, against Railway Board's letter No.2017/E(LR)III/Ref./RB/1 dated 30.01.2017, wherein Supervisors(Grade Pay of Rs.4200 and above) working in Safety Categories have been debarred from become office-bearers of the unions/federation after 31.03.2017.
I explained him that, on the one hand railway administrations wants all sorts of cooperation from the federation, on the other they are issuing such a letter wherein they are directly interfering in the unions/federation affairs.
Hon'ble MR immediately called the CRB and advised him that this issue should be resolved without any further loss of time.
In our letter as well as during the course of discussions I demanded immediate withdrawal of Railway Board's letter supra dated 30.01.2017, which is illegal and against 87th ILO Convention and having no ground for debarring the supervisors from the trade union in the name of safety.
Though the CRB has assured that, shortly needful will be done in the matter, but it is advised to all of you that we should continue our agitations till this letter of the Railway Board is withdrawn.

All of you are well aware that, All India Railwaymen's Federation (AIRF) is the most reputed and oldest federation of the Railwaymen in India; which started its journey in the year 1924.

Prior to AIRF having been formed in 1924; there were a number of Railway Unions existing on different clusters of the Railways under the British Rule. It was realized by the entities that, despite their best efforts they were struggling to safeguard and protect the rights of the Indian Railwaymen from discrimination and exploitation. The British Rulers were highly discriminating the Indian Workers and their policies were highly loaded in favour of the Anglo-Indian Workers. Thus, ignorance of the safety, security, disparity in wages, medical facilities and uncongenial working conditions to our fellow brothers working in different British Railway clusters, compelled them to create a largest and strongest platform to fight against these atrocities and to protect their interests and induce self-respect at the working place. Collective decision and concerted efforts paved the way for formation of prestigious, strong, massive and meticulous organization to work for the well being of the Railwaymen 24x7x65.
All India Railwaymen’s Federation has a history and saga of sacrifices of its workers while fighting 1960, 1968 and 1974 strikes.

Friends! You are also aware that, recently the 92nd Annual Conference of AIRF was held at Allahabad from 8-10 November, 2016, wherein a number of issues related to staff grievances and demands of the Railwaymen were deliberated and discussed and future line of action was drawn.

It may also be appreciated that, although there are number of organizations at the All India level, it is AIRF that stood tall for the Railwaymen’s demands against the anti-workers policies of the government and forced the Government of India to constitute the 7th CPC.

Dear Friends! Though 7th CPC’s recommendations have since been announced and implemented also, but I am personally aggrieved and pained that, the Pay Commission and the Government ignored many genuine demands of the Railway employees. One of our main demands was restoration of the Old Pension Scheme for the employees who joined on or after 01.01.2004 and the other was Minimum Wage as Rs. 26,000 to the staff at the lowest level. In the recommendations of the 7th CPC both the demands were ignored. Apart from this, many other demands were also either partly or fully ignored in the recommendations of the 7th CPC. I have personally taken note of the demands/issues and not only lodged our strong protest to the government, but pursued them to form the committees to review these demands. In this context we also met a Group of Union Ministers and apprised them of the gravity and genuineness of our demands and got assurance from them that these would be duly taken care of. We have also held meetings with the Cabinet Secretary, Secretary(DoP&T), Secretary(Exp.) etc. of the Government of India, to extract maximum benefits for all of you, but up till now nothing fruitful has emerged.

On this occasion I would like to congratulate all of you that, despite all odds, the long pending demands of enhancing the limit of monthly wages for payment of PLB from Rs.3500 to Rs.7000 was acceded to with the consistent efforts of AIRF w.e.f 01.04.2014, and the payment of PLB along with arrears of 2014-15 has since been made to all the fellow Railwaymen. You may also appreciate that, the orders for payment of Retirement Gratuity and Death Gratuity for all the NPS contributors has as well issued by the DoP&T on regular persuasions by us.

Further to this, one of our major demands for Merger of Technician Gr. II to Gr.I has also been acceded to by the Ministry of Railway in another way by upgrading substantial number of posts to the grade of Sr. Technician and Highly Skilled Technician Gr. I. It is also a landmark achievement, but still a number of grievances and demands are yet to be resolved, as such, the 92nd Annual Conference of AIRF unanimously decided to hold “All Indian Protest Day” on 14th December, 2016 throughout the Indian Railways.

Friends! At this stage I would also like to mention that, during the last sort span of period I was not keeping good health and remained hospitalized also for recovery from the ailment. As of now I am feeling perfectly well and energetic and assure you that I am for the AIRF and the cadre only. My life is for my fellow Railwaymen; with their good wishes I am with them.

As the year 2017 is approaching, I want to take this as opportunity to extend my heartfelt greetings to all of you and your families. You all are essential part to the success of our great federation, I would like to thank you all personally for showing immense faith and confidence.

I further like to appeal all of you to work hard for the betterment of the Railways. So long, the organization is strong, we are also strong. Thus, it is our prime duty to take proper care of duties and responsibilities towards our organization, society and to the nation.

I am sure that, all of you will give priority to organize the Youth and Women because without them AIRF cannot be strong. We should also keep in our mind Mission Future. I personally assure you that, you will always find me with you in your hour of need.

Please accept my best wishes for the New Year. I am sure that, you will work with great gusto and motivation to take-up the future challenges.

Ref: RailwayBoard’s letter No.E(NG)I-2008/PM1/15 dated 09.02.2016 (RBE No.15/2016)
The scheme of filling-up of higher grade non-gazetted posts, both "selection and non- selection", on the basis of benchmarking, is invogue on the Indian Railways for quite some time and is working well, facilitating smooth and hassle-free promotions of the non-gazetted staff. This scheme has, therefore, proved its worth and the delay in the name of selection has virtualy been weeded-out on its implementation.

AIRF had, therefore, requested to continue this scheme as "open -  ended" forever rather than extending its currency from time to time in installments.

We would, therefore, seek your personal intervention in the matter, so that timely instructions are issued to all the railway administrations to keep this scheme opened forever as the present currency is going to be expired on 31st December, 2016.

An early action in the matter shall be highly appreciated.

The first meeting of the National Anomaly Committee was held today under the Chairmanship of Secretary(P), Government of India, to discuss the issue of calculation of Disability Pension for Defence Forces Personnel as per recommendations of the 7th CPC, which was attended by the Member Staff Railway Board and the Secretaries from other departments of the Government of India.

 AIRF was represented by the undersigned and Com. J.R. Bhosale, Treasurer AIRF while Army personnel were represented by the officials of all the three wings of the defence. At the outset, I urged upon the Secretary (DoP&T), to frame the definition of the "Anomaly", which has been already demanded by the Staff Side, NC/JCM.

This is in respect of report of the VII CPC, which has granted slab system on Disability Pension for the Defence Personnel, which was far short of the existing disability pension for the army officers. We explained the life of the army personnel and their cases of disability in the enemies’ action.

After threadbare discussions we urged upon the Official Side to see that there is no drop in the disability pension for any of the categories of the army personnel and paramilitary forces, rather they should be well compensated for their best they are giving for defending our motherland.

The undersigned is directed to refer Ministry of Finance's OM dated 21.11.2016 advising this Ministry to nominate names of representatives of recognized Federations/Staff Associations of Indian RaiIways to present their views on Allowances pertaining to Ministry of Railways in the meeting scheduled to be held on 28.11.2016 at North Block.

2. It is advised that the following representatives would be representing the recognized Staff Federations of Indian Railways in the aforesaid meeting.

(i) Shri Shiv Gopal Mishra, General Secretary, AIRF
(ii) Dr. M. Raghavaiah, General Secretary, NFIR.

3. With regard to the request forwarded by All India Train Controllers Association and All India Guard Council to call them for the aforesaid meeting, it is state that this Ministry is of the view that the request may not be acceded to as both associations are un-recognized and acceding such request will result in similar demands from large number of un-recognized associations in Ministry of Railways. It is also stated that All India Railwaymen’s Federation (AIRF) and National Federation of Indian Railwaymen (NFIR) are only two recognized federations of Indian Railways.

Sub: Fixation of pay of existing Group ‘D’ employees in the revised pay structure – clarification reg.

Consequent upon implementation of recommendations of 6th CPC as accepted by Govt. of India, instructions regarding placement and fixation of pay of Group ‘D’ employees (other than RPF/ RPSF) in Grade pay of Rs. 1800/- in PB-1 (Rs. 5200- 20200) were issued vide Board’s letter of even number dated 29.10.2008 (RBE No. 160/2008). Further clarification/ instructions on the issue were issued vide Board’s letters of even number dated 12.01.2009 & 08.11.2010.
2. On the basis of various references received from Zonal Railways and an Item being raised by NFIR on the issue; the matter has been further examined in consultation with the Ministry of Finance keeping in view the stipulation contained in Note I under Rule 7 (1) of Railway Service (Revised Pay) Rules, 2008 and it has been decided that those non-matriculate/ non-ITI Group ‘D’ employees, who were in service on the date of notification of Railway Service (Revised Pay) Rules, 2008 and retired/ expired or left service within six months of the notification of the Railway Services (Revised Pay) Rules, without being imparted training due to administrative reasons, may be placed in PB-1 with Grade Pay Rs. 1800/-

3. This issues with the concurrence of Finance Directorate of this Ministry.

Sub: Brief of the 4th meeting of the Empowered Committee of Secretaries(ECoS) held on 30.03.2016 to discuss the recommendations of the VII CPC

The 4th meeting of the Empowered Committee of the Secretaries(ECoS) was held today under the Chairmanship of the Cabinet Secretary, Government of India, to discuss the recommendations of the VII CPC.

The meeting was held in a cordial manner on the general issues related to VII CPC, viz. Minimum Wage, Multiplying Factor, NPS, Minimum three cadre promotions, Allowances & Advances, Child Care Leave to Women Employees, MACPS, etc.

Apart from this, we represented the arduous conditions under which railway employees are working and how many railwaymen are sacrificing their lives for smooth running of the Indian Railways and tried to prove that we are more important even to the Defence of the country.

We also discussed various issues where justified approach has not been done, particularly reg. Running Staff(one additional pay scale), Technicians(merger of Technician Gr. II with G. I in GP Rs.2800) and Technical Supervisors, Group `B’ status to Supervisory Staff, parity field staff with the Ministry Staff and other categorical problems.

Member Staff, Railway Board, was also present during the presentation made by the federations. Chairman, Railway Board, is also a member of the Empowered Committee along with other Secretaries of the Government of India.
