For availing of medical facilities under Central Government Health Scheme (CGHS), parents are deemed to be dependent on the Central Government employee if they are normally residing with the employee and their monthly income from all sources including pension/ family pension does not exceed Rs. 9,000 plus the amount of Dearness Relief thereon. This condition of dependency is applicable to Pensioners of State Government(s) as well.

Regarding any scheme for providing medical facility to the dependent parents of employees of private sector, The Employees’ State Insurance (ESI) Act, 1948 read with ESI (Central) Rule, 1950 provides for medical benefits to the dependent parents of the Insured person i.e. an employee who works in a factory/ establishment having 10 or more workers & registered under the said Act and drawing salary less than Rs. 21,000 per month (Rs. 25,000 in case of persons with disability). Income limit for dependency of parents from all sources is Rs. 9,000 per month. The ESI Act is not applicable to Central Government employees and their dependents.

The Minister of State (Health and Family Welfare), Sh Ashwini Kumar Choubey stated this in a written reply in the Lok Sabha here today.

Subject: Reimbursement of medical claims to Pensioners under CS(MA) Rules 1944 - guidelines issued by Ministry of Health & Family

Ministry of Health and Family Welfare vide its OM No. S.14025/23/2013-MS.EHSS dated 29th September 2016 has clarified that CS (MA) Rules 1944 are not applicable to pensioners till date. The Ministry has issued the following guidelines for medical facilities to Central Government pensioners:-

a) Pensioners residing in CGHS covered areas:

  1. They can get themselves registered in CGHS dispensary after making requisite contribution and can avail both OPD and IPD facilities.
  2. Pensioners residing in CGHS areas cannot opt out of CGHS and avail any other medical facility (i.e. Fixed Medical Allowance). Such pensioners, if they do not choose to avail CGHS facility by depositing the required contributions, cannot be granted Fixed Medical allowance in lieu of CGHS.

b) Pensioners residing in non-CGHS areas:

  1. They can avail Fixed Medical Allowance (FMA) © Rs. 500/- per month revised to Rs. 10001- from 01.07.2017.
  2. They can also avail benefits of CGHS (OPD and IPD) by registering themselves in the nearest CGHS city after making the required subscription.
  3. They also have the option to avail FMA, for OPD treatment and CGHS for IPD treatments after making the required subscriptions as per CGHS guidelines.
2. All retired/ retiring Officers/ Staff of the Defence Accounts Department may please be advised to adhere to the above provisions and subscribe to CGHS facility by depositing the required contributions for availing medical facilities after retirement.

Sub: CGHS facilities to NPS covered Pensioners - Req.
Ref.: Ministry of Health & Family Welfare, Government of India’s G.O.No.S.11011/ 10/2012- CGHS(P)/ EHS dated 28.03.2017

Your kind attention is invited towards the above referred to O.M. dated 28th March, 2017, wherein a condition of Minimum Qualifying Service of 10 years has been laid down for availing CGHS facilities for NPS covered pensioners.

In this connection, it would not be out of context to mention that, a substantial number of Gramin Dak Sewaks became regular employees of the Postal Department, crossing age of 50 years. All these CDSs, on having been regularised as Postal Employees after 50 years of age, are thus deprived of CGHS facilities on account of above-mentioned condition of minimum 10 years Qualifying Service, as such, the said condition is uncalled for an irrational.

It is, therefore, requested that, the matter may please be looked into in the foregoing, and the same be dispensed with, so that, any regular Government Employee on superannuation, may be NPS covered pensioners, should be allowed to avail CGHS facilities without any bar of Minimum Qualifying Service in the larger interest of justice.

With reference to the above subject the undersigned is directed to draw attention to Circular No 4-20/2003 - C&P Section dated the 28th April , 2005 vide which guidelines were issued for supply of OPD Medicines for upto '6' months to CGHS beneficiaries , who are going to stay abroad and to state that the matter has been reviewed by this Ministry and it is now decided in modification of the earlier guidelines that hereinafter, Chief Medical Officer I/C of concerned CGHS Wellness Centre is empowered for issue of OPD medicines for upto six months to the CGHS beneficiaries visiting abroad, subject to submission of the following documents:

(a) Copy of valid CGHS Card.
(b) Valid prescription for six months.
(c) Documentary Proof of going abroad like ticket , visa etc.

Subject: Annual Health Check-up at Hospitals empanelled under CGHS in respect of CGHS Pensioner beneficiaries (Primary card holders) aged 75 years and above- regarding

With reference to the above mentioned subject, the undersigned is directed to state that the matter relating to Annual Health Check-up at private hospitals empanelled under CGHS in respect of elderly CGHS beneficiaries was under consideration at this Ministry and it has now bean decided that hereinafter, CGHS Pensioner beneficiaries {Primary Card holders) aged 75 years and above shall be permitted to undergo ‘Annual Health Check-up’ at CGHS empanelled hospitals.

Permission in respect of CGHS Pensioner beneficiaries (Primary Card holders) aged 75 years and above shall be granted by CMO in charge of CGHS Wellness Centre.

The private hospitals empanelled under CGHS shall perform the Annual Health Check-up at CGHS rates and extend cashless facility for the same in respect of CGHS Pensioner beneficiaries (Primary Card holders) aged 75 years and above.

CGHS Wellness Centres provide primary health care facilities and, if required, refer the beneficiaries to the Specialists at Government Hospitals/ Private Hospitals empanelled under CGHS. In emergency conditions, no endorsement for any treatment/ investigation is required from CGHS Wellness Centre. However, in non-emergency conditions or unlisted treatment/ tests, endorsement from concerned CGHS Wellness Centre is required.

With a view to facilitate ease of availing consultations from Specialists at empanelled hospitals, Government has permitted elderly CGHS beneficiaries aged 75 years and above to seek consultations from Specialists without any referral and undergo treatment/ investigations without endorsement. Permission is required only for unlisted treatment procedure/ tests in non-emergency conditions.
The guidelines for referral issued vide Office Memorandum No. Z.15025/117/2017/DIR/ CGHS/EHS, dated the 15th January, 2018 have been modified vide Office Memorandum No. Z.15025/117/2017/ DIR/CGHS/EHS, dated the 10th December, 2018 and the following modifications have been made in the interest of sick people, pensioners and serving employees:-

The referral shall be valid for consultations upto 3 times in the same hospital within 30 days.
CGHS beneficiaries have been permitted to consult upto 3 Specialists, if required during a single visit.

III. Investigations advised by Specialist of Private Empanelled Hospitals may be undertaken if they are required in emergency as certified by Specialist without endorsement by CGHS.

The Minister of State (Health and Family Welfare), Sh Ashwini Kumar Choubey stated this in a written reply in the Lok Sabha, here today.

Who are covered by CS (MA) Rules?
They shall apply to all Government servants other than (i) these in railway
service and (ii) those of non-Gazetted rank stationed in or passing through Calcutta, whose conditions of service are prescribed by Rules made or demand to be made by the Central Government, when they are on duty, leave or Foreign Service in India or which under suspension.

Who is an AMA?
Authorised Medical Attendant (AMA) is Medical Officer in the employee of Central Government or Private Medical Practitioner appointed/ nominated by the Ministry/Department for providing medical attendance to its employees.

What is the Reimbursement in case of treatment taken under emergency at private hospital?
CS(MA) beneficiaries are being reimbursed as per the prevailing non NABH CGHS as applicable to a CGHS covered city and non-NABH rates applicable
to the nearest CGHS covered city in case of non-CGHS city, as the case may be, or the actual, whichever is less, for treatment undertaken at private hospitals under emergent condition.

What are the hospitals in which CS(MA) beneficiary are entitle for treatment under normal conditions?
CS(MA) beneficiaries and their dependent family members can get treatment from any of the Central Government hospitals/ State Government hospitals/ private hospitals and diagnostic centers recognized under CGHS/ CS(MA) Rules as per provisions.

Can a Central Government Employee gets reimbursement is treatment
undertaken aboard?

Treatment abroad is considered under CS (MA) Rules, 1944, on receipt of application in the prescribed format through the employee’s Ministry/ Department. However, approval depends on the opinion of the standing Committee constituted under these rules.

Ministry of HRD, vide letter No.F3-5/2011-UT-2 dated:13-03-2019 has conveyed the approval of the Ministry of Health & Family Welfare O.M.No.S.11016/8/2015-CGHS (P) dated 06.03.2019 vide which Ministry of Health & Family Welfare has extended the implementation of CGHS facilities to all the retired employees of KVS, who were having CGHS cards while in service, in all CGHS covered Cities, on the same terms and conditions on which retired employees of KVS were extended CGHS facilities in Delhi/NCR vide Ministry of Health & Family Welfare OM dated 29.05.2015.

Other terms and conditions of MoH&FW OM dated 29.05.2015 circulated vide KVS (HQ) OM No.11086/01/2012-KVS HQ (Admn.II) 793/805 dated 21.08.2015 will remain unchanged.

General of Health Services and their family members covered under CGHS on credit basis on the basis of advice from CGHS Medical Officer/Govt Specialist in case of listed treatment procedures/investigations and with valid permission letter in case of unlisted treatment procedures/investigations as the case may be. In addition the HCOs shall continue to provide treatment on credit basis for treatment under emergency.

Payment of Conveyance Allowance to IRMS Doctors for paying domiciliary visits outside duty hours and performing other official duties is governed by Board's letter No. F(E)I/2009/AL-7/1 dt. 24.07.2009. This order is based on Ministry of Health & Family Welfare's C.M. No. A-450-12/03/2008­CHS-V, dated 28/04/2009.

Now pursuant to Ministry of Health & Family Welfare's recent C.M. No.Z15025/DIR/CGHS/Conveyance/JACSD0/2017/744252, dated 02/02/2018 on the subject matter of Conveyance Allowance admissible to CHS Doctors working under CGHS, it is reiterated that the instructions as contained in Board's letter No. F(E)I/2009/AL-7/1, dt. 24.07.2009 shall be applicable for payment of Conveyance Allowance to IRMS doctors for paying domiciliary visits outside duty hours and performing other official duties.

Subject: Engagement of workers in Grih Kalyan Kendra New Delhi for gaining work experience.

The Grih Kalyan Kendra (GKK) is a registered Society under the Societies Registration Act, 1860, functioning under the aegis of Department of Personnel and Training, Ministry of Personnel Public Grievances and Pensions, Government of India. The GKK runs various welfare activities for the benefit of Central Government employees and their dependents.
  1. The main objective of the Kendra is to help the needy Central Government employees belonging to lower income groups, who are in genuine financial and psychological need of temporary rehabilitation, by giving them training and experience which would enable them to supplement their domestic income and help them to acquire skill and experience for seeking better avenues of employment elsewhere.
  2. They are paid only honorarium and are not entitled to any service benefits. It is expected only to be a stepping stone and training ground for more needy dependants of Central Government employees, but not to give them any regular employment.
  3. It is proposed to engage workers for the following posts in Grih Kalyan Kendra at New Delhi from the dependents of Central Government employees / retired Govt. employees having the requisite qualifications etc as given below:-

5. The workers in GKK are engaged initially for a period of one year. However, the engagement may be extended by the Competent Authority up to a maximum period of five years on year to year basis, subject to satisfactory performance and requirement for continuation of the post. The persons so engaged shall be paid a fixed monthly honorarium as mentioned above or as directed by the GKK Board from time to time.

6. It is requested that wide publicity may kindly be given to this circular amongst the Central Govt. employees working in the Ministry / Department including attached and subordinate offices, who may apply as per the enclosed format for the post for which they are eligible. The completed applications along with required documents may be forwarded to Secretary, Grith Kalyan Kendra, Samaj Sadan, Lodhi Road Complex, New Delhi - 110003 within a period of 30 days from the date of issue of this Circular, Applications completed in all respects, shall only be considered.

Subject: Booking of CGHS Recovery into Heads of Defence Accounts.

As per list of Major & Minor Heads of Accounts, recovery on accounts of CGHS contribution should be booked under Receipt Head 0210.01.103.00.00 {code heads 094/16-Defence, 095/16-MoD(Civ) & 098/20-CSD}.

2. However, Test Audit of pay bills pertaining to Defence Civilians in one of our Controller Offices revealed that a recovery of CGHS subscription is being booked under MH-0076, Minor Head 800-Other receipts (code head 01/575/30). Similarly, CGHS contribution of Civilians of Navy and Air Force is being booked under MH- 0077, Minor Head 800-other receipts (code head 01/670/30) and Major Head 0078, Minor Head 800-Other receipts (code head 01/710/30) respectively.

3. While your office is booking a significant amount under the code head 094/16, it may be possible that the recovery on account of Defence Civilians not being booked under the appropriate heads.

4. It is therefore, requested to review the booking on account of recovery of CGHS contribution by your office and furnish the practice being followed and code heads being used by your office for booking of said recovery in r/o both DAD & Non-DAD subscribers. The review may be completed by 27.06.2018.

Subject: Empanelment of private hospital (including dental clinics and eye centres) and diagnostic centres under CGHS Delhi & NCR.

In continuation of this Directorate's Office Memorandum of even no. dated 26.12.2017 regarding empanelment under continuous empanelment scheme, the undersigned is to convey that in addition to the list of the hospitals (including dental clinics & eye centres) and diagnostic laboratories already empanelled, the hospitals (including dental & eye centres) and diagnostic laboratories as per the list attached (22 HCOs) have also been empanelled under CGHS in Delhi & NCR with issuance of this order. The newly empanelled hospitals (including dental clinics & eye centres) and diagnostic laboratories may be treated as included in the existing list of empanelled health care organization under CGHS on same terms and conditions as have been indicated in the Office Memorandum dated 26.12.2017.

Empanelment and De-Panelling of Private Hospitals under CGHS

CGHS empanels eligible private hospitals as and when they apply and sign Memorandum of Agreement as per terms and conditions of empanelment under tender process/continuous empanelment scheme.

Some private hospitals have opted out of CGHS. The details are at Annexure.

The above statement said in a written reply to a question in Parliament on 20.3.2018 by the Minister of State for Health and Family Welfare Shri Ashwini Kumar Choubey.

Subject: Extension of CGHS to all retired employees of Kendriya Vidyalaya residing in Delhi/NCR- regarding.

Consequent upon KVS's proposal on the subject vide letter dated 29.09.2017, the Deputy Secretary (UT), Ministry of Human Resource Development vide his letter No.F.3-5/2011-UT-2 dated 02.02.2018 to be reqd with MHRD's letter of even number dated 19.03.2018 has conveyed the decision of Ministry of Health and Family Welfare, Government of India, New Delhi regarding extension of CGHS facilities to all retired employees of Kendriya Vidyalaya Sangathan (KVS) residing in Delhi/ NCR.

2. Accordingly, medical facility under the CGHS is to all retired employees of Kendriya Vidyalaya Sangathan residing in Delhi/ NCR.

Sub: Simplification of procedure for treatment at private hospitals empanelled under CGHS/CS (MA) Rules, 1944

With reference to the above mentioned subject the undersigned is directed to state that this Ministry has been receiving representations for simplification of procedure for undergoing treatment at private hospitals empanelled under CGHS. The matter has been examined and it has now been decided that CGHS beneficiaries are allowed to undergo treatment at private hospitals empanelled under CGHS of specific treatment procedures listed under CGHS rate list are advised by a Specialist in a Central Government / State Govt. Specialist hospital or a CGHS Medical Officer without any requirement of any other referral (permission) letter.

2. Private empanelled hospitals shall perform the treatment on cashless basis in respect of pensioners, ex-MPs, Freedom Fighters, Regular employees {both CGHS and CS (MA) beneficiaries} of this Ministry & other categories of CGHS beneficiaries, who are presently eligible for credit facility and shall enclose the prescription issued by Government Specialist or a CGHS Medical Officer, in original (or a self-attested photocopy) along with the hospital bill submitted to the competent authorities.

3. Serving government employees shall enclose the prescription issued by a Government Specialist or a CGHS Medical Officer in original (or a self-attested photocopy), while submitting the medical claim to the concerned Ministry /department/office for reimbursement.

4. CGHS Medical Officer / Government Specialist shall not refer the beneficiaries to any particular empanelled hospital by name but, shall specify the treatment procedure and mention 'referred to any CGHS empanelled centre'.

5.These orders are applicable only in respect of treatment procedures for which CGHS rates are available.

6.This issue with the concurrence of IFD vide FTS No. 3130849, dated 09.11.2017.

1. Refer:-

2. In all stations with ECHS polyclinics local medical stores/ chemists will be empanelled for supply of Not Available, emergent, life saving and essential drugs on as required basis. The empanelment of local medical stores/chemists will be done by a Board of Officers constituted by the Station Commander which will comprise the following
Chairman - SO ECHS/Col Rank officer detailed by Station Commander.
- Lt Col (Non Medical) detailed by Station Commander
- Jt Dir Hospital Services of Regional Centre concerned/ Medical Officer detailed by Station Commander
- Rep of LAO/ CDA

3. Actions by the Board.
(a) The Board of Officers will invite Tenders through advertisement in the local press and e-procurement portal from local medical stores/chemists for empanelment with ECHS Polyclinic. The tender enquiry will be based on same format as CGHS tender for Authorised Local Chemist with conditions suitably modified to suit local military requirements (CGHS tender format att as Encl 2).

(b) The Board will check the Technical parameters as per Tender Enquiry and will consider the price bids of only the technically qualified vendors. The Board will arrive at L 1 Vendor based on maximum overall amount of discount on MRP for all the drugs to be supplied with a minimum OR of 15%. Bids offering less than 15% overall Discount will be rejected. The tenderers will quote an overall discount figure irrespective of the quantity or number of individual drugs.

(c) The Board will consider parallel rate contract with L2 and L3 vendors and include their names in recommendation if those vendors agree to the L1 rates in writing.

(d) The Board of Officers will submit a recommended list of local medical stores/chemists to the Station Commander for approval.
4 Actions by Station Cdrs
(a) Constitute a Board of Officers for empanelment of local medical stores/chemists including CGHS authorised chemists. Due care is to be exercised in choice of Medical officer to avoid any conflict of interest. MOs/Spl posted to Ml-l of SEMO concerned to be avoided and MOI RMO of non medical units may preferably be detailed as JDl-lS of RC may be occupied in similar bds for other stns under AOR.

(b) Approval of recommended list of local medical stores/chemists submitted by the Board of Officers.

(c) All CGHS Authorised Chemists in the same city will be considered as deemed empanelled i.e need not participate in TE if the rates planned to be quoted are same as given for CGHS. They will give their contract discount documents for CGHS to the board, but will sign the contract with Stn Cdr provided the discount offered by them to CGHS is not less than that offered by L1 vendor of the TE. They have option to participate in the empanelment process and offer fresh quotes discounts at the TE Stage.

(d) The Contract will be signed with the approved local medical stores/chemists by Stn HQrs for a period of two years. The terms and conditions of Contract will be based on CGI-lS formats.

(e) The Officer in charge Polyclinic will after due verification authenticate the receipt of drugs/consumables and forward the consolidated bills by the 5th of the following month to the Stn HQrs.

(f) Stn Cdr will process the same for releasing payment with sanction of appropriate CFA.

(g) Payment: The payments on account of procurement of drugs and consumables from empanelled local chemists will be made from the cash assignments placed at the disposal of Station Commanders under Major Head 2076 Minor Head 107 Head 363/01. The payments will be effected by cheque/ electronic payment.

(h) Delegated financial powers as per Para 1 of Appendix to GOI letter No 24(3)IO3IlJS(WE)/D(Res)(i) dated 08 Sep 03 amended vide 25(01)12014/US(WE)ID(Res) dated 04 Aug 14 will be exercised by CFA. The delegated powers are enumerated in table below:

(j) The monetary ceilings for expenditure irrespective of their Military or Non Military status are as follows:-
Type A & B Polyclinic : Rs 2.5 Lakh per month
Type C Polyclinic : Rs 1.5 Lakh per month
Type D Polyclinic : Rs 01 Lakh per month
Prior approval of MD ECHS will be required for any expenditure above this limit.

(k) The expenditure on account of local purchase of drugs and consumables from empanelled local medical stores/chemists will be monitored separately under the relevant revenue head.

(l) The records of polyclinic will be checked by a Boards of Officers detailed by the Station Commander.
5. Actions by Polyclinic : When an emergent/life saving/essentlal drug prescribed by the Medical Officer in the ECHS Polyclinic is not available as confirmed from the stock by the medical store of polyclinic and requirement of the same is essential for a patient, following procedure will be followed:-
(a) The Officer in charge Polyclinic will raise a demand to the empanelled local medical store/chemist. The demand will be supported by prescription(s) signed by the Medical Officer managing the case.

(b) On receipt of the demand the empanelled local medical store/chemist will supply the required drug to the Polyclinic within 24 hrs.

(c) The Bills for the drugs supplied will be forwarded by the empanelled local medical store/chemists monthly to the Officer in charge Polyclinic along with a copy of the demand raised by the Polyclinic.

(d) The Officer in charge Polyclinic will, after due verification, authenticate the receipt of drugs/consumables and forward the consolidated bills by the 5th of the following month to the Stn HQs.

(e) The Officer in charge Polyclinic will also certify on the consolidated bill that drugs demanded are emergent/life saving/essential drugs and are Not Available in the polyclinic medical stores neither a substitute! equivalent drug was available.

(f) Stn Cdr will process the same for releasing payment with sanction of appropriate CFA.

(g) The list of drugs and consumables indented from local chemists alongwith quantity indented
will be included in the next Emergent/ Normal polyclinic indent to SEMO.

(h) Monthly list of such drugs will be forwarded to SEMO for initiating procurement action by SEMO while forwarding the next demand.

(j) The Polyclinics will maintain a separate account for all purchases of this nature. All daily transactions will be maintained and particulars of patients who are issued the essential medicines will be recorded. The records will be checked by a Boards of Officers detailed by the Station Commander, and will be audited by Local Audit Officer (LAO) every quarter.
6. Funds required will be placed at the disposal of Station Commanders by Central Organisation ECHS. Due control shall be exercised by MOs/ Spll OiC Polyclinics and Stn Cdrs to ensure that the monthly limit is available to maximum patients and is not exhausted in procuring medicines for a few patients. Existing provisions for reimbursement of costlier medicines for the diseases specified in Para 6 of GOl/MOD letter No 24(8)IO3IUS(WE)ID(Res) dt 19 Dec 03 for a period of 23/30 days may also be explored to benefit maximum number of veterans.

7. Special Instructions to MOs/Spls of Polyclinics and Empanelled Hospitals.
(a) The demand for NA medicines will be supported by prescription signed by the Medical Officer! Spl of ECHS polyclinic managing the case. In all such cases. the Medical Officer / Spl will ensure that there ar e no other substitutes available in the Polyclinic medical store in lieu of the drug required. Branded drug will be prescribed with due medical justification only. Demands will not be signed by Para Medical/Dental Staff under only circumstances.

(b) As specified in MCI Ethics Rules, pharmacy of a polyclinic is not an open pharmacy but is meant as self dispensing of medicines prescribed by Medical Officers/ Doctors of polyclinic only. All other prescriptions issued by other consultants shall be rewritten by polyclinic doctor keeping in mind availability. patient’s condition and other drugs prescribed.

(c) Prescription of branded medicine by empanelled hospitals will have to be justified by treating Doctor and should be avoided as per National Policy. The AFV should also not insist on particular brand name of medicine if an equivalent is available in Polyclinic or supplied by Empanelled Local Chemists.
