Dear Sir,
Sub: Payment of Productivity Linked Bonus to the Railway employees for the year 2018-19.

NFIR brings to your kind notice that the Productivity Linked Bonus formula was conceptualized in November, 1979 by an agreement between the Federations and Railway Ministry. So far as the Salary Calculation Ceiling for the purpose of payment of P.L. Bonus is concerned, you may kindly be aware that the notional salary at Rs. 7000/- p.m. is taken into account and amount arrived at NFIR has been repeatedly urging upon the Railway Ministry to remove salary calculation ceiling for making payment of P.L. Bonus to the Railway employees on actual wages as the payment is linked with productivity. This was also part of Charter of Demands of NFIR placed before the Railway Ministry when Strike Notice was served on 09th June, 2016. However, this issue is yet to be resolved.
So far as payment of P.L. Bonus for the year 2018-19, to be paid to Railway employees before the commencement of Dussehra Puja Holidays is concerned, NFIR places the following facts for kind appreciation : -
  • Despite over 2 & half lakh vacancies, the Railway employees have given qualitative output during the year 2018- 19, shouldering additional burden which fact needs to be given greater consideration for the purpose of revising the number of days wages upwardly for payment of P.L. Bonus.
  • Over two lakh employees have been performing twelve hours duty per day, despite justification exists for introduction of eight hours duty under "Continuous" classification on the basis of Job Analysis. The Zonal Railways are yet to comply with Railway Board's instructions dated 30th September, 2016 for revising the classification from 'EI' to 'Continuous' . This also needs to be given due weightage.
  • The overall performance of Railway employees has been 'Very Good' as there has been no dislocation/ detention on employees' account.
  • During the previous seven years, the P.L. Bonus was paid to Railway employees equivalent to 78 days wages (with notional salary calculation). Upward revision of P.L. Bonus days beyond 78 days wages, would motivate Railway employees to continue to perform with determination.
  • Federation insists that Capital input should not be taken as criteria at all, as the utilization of the said Capital is in the hands of management as workers are not concerned with said investment. It is further placed on record that at no point of time, consultations were made with the Federations on the need for capital investment or otherwise.
Summing up, NFIR urges the Railway Board (CRB) to kindly consider for enhancement of number of days wages than previous years for payment of Productivity Linked Bonus to Railway Employees before commencement of Dussehra Puja Holidays.

Sub: Declaration of Productivity Linked Bonus (P.L.B.) for the employees of the EPFO for the year 2017-2018.

Madam/Sir,

The Central Government has conveyed its approval to the existing Productivity Linked Bonus Scheme for the year 2017-2018 for the employees of EPFO vide MoL&E letter No A-26022/1/94-SS.1 (Pt) dated 12th October, 2018.

2. Accordingly, the competent authority is pleased to convey the approval for payment of the Productivity Linked Bonus for the year 2917-2018 for 60 (Sixty) days in all the offices of EPFO. The bonus of 60 days has been assessed on the basis of data/information submitted by the Zonal Offices in compliance to Head Office letter dated 25.09.2018. The payment of bonus is to be released to all Group 'C' and Group 'B' (Non-Gazetted) employees of EPFO.

3. The terms and conditions governing payment of P.L.B. will be as per the instructions issued by the Ministry of Finance O.M. No. 7/24/2007/E.III(A) dated 08.10.2018 for payment of the bonus to the employees in Central Government departments from time to time. However, the quantum of bonus may be assessed as per the following formula, as given in above letter:-

Subject: Payment of Productivity Linked Bonus to all eligible non-gazetted Railway employees for the financial year 2017-18.

The President is pleased to sanction Productivity Linked Bonus (PLB) equivalent to 78 (Seventy Eight) days wages without any ceiling on wages for eligibility for the financial year 2017-18 to all eligible non-gazetted Railway employees (excluding all RPF/RPSF personnel). Where, wages exceed Rs.7000/- per month, Productivity Linked Bonus will be calculated as if the 'wages' are Rs. 7000/- p.m.

2. 'Wages' for the purpose of calculating Productivity Linked Bonus shall include 'Basic pay'as defined in the Railway Services (Revised Pay) Rules, 2016 and dearness allowance drawn during the financial year 2017-18. Other conditions of eligibility, method of calculation of wages, etc., as prescribed in this Ministry's instructions and clarifications issued from time to time, shall remain unchanged.

3. It has also been decided that in the case of eligible employees mentioned in Para 1 above who were not placed under suspension, or had not quit service/retired/expired during the financial year 2017-18 or were on leave where leave salary admissible is not less than that admissible on leave on average pay, may be paid an amount of Rs.17,951/- towards Productivity Linked Bonus for the financial year 2017-18. In the case of employees other than those mentioned above, the amount of Productivity Linked Bonus may be calculated in accordance with the extant instructions on the subject.

4. Further, in relaxation to the provisions in Rules 905(2), 908 and 909 of State Railway Provident Fund Rules, as contained in Chapter 9 ofR-I/1985 edition (2003 Reprint edition), such of the subscribers to the SRPF as are entitled to Productivity Linked Bonus may, if they so desire, deposit the whole or pat1 of the amount admissible under the Scheme in their respective State Railway Provident Fund Accounts.

5. Disbursement of Productivity Linked Bonus for the financial year 2017-18 to all eligible non-gazetted Railway employees mentioned in Para 1 above should be made on priority in the same mode as payment of salary before the ensuing Puja/Dussehra holidays.

6. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

Cabinet approves Productivity Linked Bonus for Railway Employees

Productivity Linked Bonus (PLB) equivalent to 78 days' wages for the financial year 2017-18 for all eligible non-gazetted Railway employees 

About 11.91 lakh non-gazetted Railway employees are likely to benefit from the decision

Payment of 78 days' PLB to railway employees has been estimated to be Rs. 2044.31 crore
The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved the payment of Productivity Linked Bonus (PLB) equivalent to 78 days' wages for the financial year 2017-18 for all eligible non-gazetted Railway employees (excluding RPF/RPSF personnel). The financial implication of payment of 78 days' PLB to railway employees has been estimated to be Rs.2044.31 crore. The wage calculation ceiling prescribed for payment of PLB to the eligible non-gazetted railway employees is Rs.7000/- p.m. The maximum amount payable per eligible railway employee is Rs.17,951 for 78 days. About 11.91 lakh non-gazetted Railway employees are likely to benefit from the decision.

The Productivity Linked Bonus on Railway covers all non-gazetted railway employees (excluding RPF/RPSF personnel) who are spread over the entire country. Payment of PLB to eligible railway employees is made each year before the Dusshera/ Puja holidays. The decision of the Cabinet shall be implemented before the holidays for this year as well. For the year 2017-18 PLB equivalent to 78 days' wages will be paid which is expected to motivate the employees for working towards improving the performance of the Railways.

Background:
Railways were the first departmental undertaking of the Government of India wherein the concept of PLB was introduced in the year 1979-80. The main consideration at that time was the important role of the Railways as an infrastructural support in the performance of the economy as a whole. In the overall context of Railway working, it was considered desirable to introduce the concept of PLB as against the concept of Bonus on the lines of ‘The Payment of Bonus Act - 1965'.

Subject: Grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) to Central Government Employees for the year 2017-18

The undersigned is directed to convey the sanction of  the President to the grant of Non-productivity Linked Bonus to  30 days emoluments for the accounting year 2017-18 to the Central Government employees in Group 'C' and all non-gazetted employees in Group B, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc Bonus under these orders shall be monthly emoluments of Rs. 7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.

2. The benefit will be admissible subject to the following terms and conditions:-

(i) Only those employees who were in service as on 31.3.2018 and have rendered at least six months of continuous service during the year 2017-18 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months):

(ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non- PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will, thereafter, be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 7000 (where actual average emoluments exceed Rs. 7000), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000×30/30.4=Rs.6907.89 (rounded off to Rs.6908/-).

(iii) The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i,e.Rs.1184 21 (rounded off to Rs.1184/-). in cases where the actual emoluments fall below Rs.1200/- p.m., the amount will be calculated on actual monthly emoluments.

(iv) All payments under these orders will be rounded off to the nearest rupee.

(v) Various points regarding regulation of Ad-hoc / Non-PLB Bonus are given in the Annexure.

3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances of these employees are debited.

4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/Departments for the current year.

5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned. these orders are issued in consultation with the Comptroller and Auditor General of India.

Regulation of Ad-Hoc and Non-PLB Bonus - Finmin Clarification

Various points regarding regulation of Ad-hoc and Non PLB Bonus are given below…

Clarification

1. Whether the employees in the following categories are eligible for the benefit of ad-hoc bonus for an accounting yearSubject to completion of minimum six months continuous service and being in service as on 31st March, 2018.
(a) Employees appointed on purely temporary ad-hoc basis.(a) Yes, if there is no break in service.
(b) Employees who resigned, retired from service or expired before 31st March, 2018.(b) As a special case only those persons who superannuated or retired on invalidation on medical grounds or died before 31st′ March, 2018 but after completing at least six months regular service during the year will be eligible for the ad-hoc bonus on pro rata basis in terms of nearest number of months of service.
(c) Employees on deputation/foreign service terms to state governments, U.T.Governments, Public Sector Undertakings, etc., on 31st March, 2018.(c) Such employees are not eligible for the ad-hoc bonus to be paid by the lending departments. In such cases the liability to pay ad-hoc bonus lies with the borrowing organization depending upon the ad-hoc bonus/PLB/ex-gratiafincentive payment scheme, if any, in force in the borrowing organization.
(d) Employees who reverted during accounting year from deputation on foreign service with the organizations indicated in 'C' above.(d) The total amount of bonusiex-gratia received for the accounting year from foreign employer and the ad-hoc bonus, if any, due from a central government office for the period after reversion will be restricted to the amount due under ad-hoc bonus as per these orders.
(e) Employees from state Government/U.T. Admn./Public Sector Undertakings on reverse deputation with the Central Government.(e) Yes, they are eligible for ad-hoc bonus to be paid by the borrowing departments in terms of these orders provided no additional incentive as part of terms of deputation, other than Deputation Allowance, is paid and the lending authorities have no objection.
(f) Superannuated employees who were re-employed.(f) Re-employment being fresh employment eligibility period is to be worked out separately for re-employment period; the total amount admissible, if any. for prior to superannuation and that for re-employment period being restricted to the maximum admissible under ad-hoc bonus under these orders.
(g) Employees on half-Pay leave/E.O.L/Leave not due/study leave at any time during the accounting year.(g) Except in the case of leave without pay the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of E.O.L./dies non will be excluded from eligibility period but will not count as break in service for the purpose of ad-hoc bonus.
(h) Contract employees(h) Yes. if the employees are eligible for benefits like dearness allowance and interim relief. Categories not eligible for these benefits would be considered at par with casual labor in terms of ad-hoc bonus orders.
(i) Employees under suspension at any time during the accounting year.(i) Subsistence allowance given to an employee under suspension for a period in the accounting year cannot be treated as emoluments, Such an employee becomes eligible for the benefit of ad-hoc bonus if and when reinstated with benefit of emoluments for the period of suspension, and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay.
(j) Employees transferred from one Ministry./Department/Office covered by ad-hoc bonus orders to another within the Government of India or a Union Territory Government covered by ad-hoc bonus orders and vice versa.(j) Employees who are transferred from any of the Ministry/Department/Office covered by ad-hoc bonus orders to another such office without break in service will be eligible on the basis of combined period of service in the different organizations. Those who are nominated on the basis of a limited departmental or open competitive exam from one organization to a different organization will also be eligible for the ad-hoc bonus. The payment will be made only by the organization where he was employed as on 31st March,2018 and no adjustments with the previous employer will be necessary.
(k) Employees who are transferred from a Government Department/Organization covered by ad-hoc bonus orders to a Government Department/Organisation covered by productivity - Linked Bonus scheme or vice versa.(k) They may be paid what would have been paid on the basis of emoluments in ad-hoc bonus covered department for the entire year less the amount due as productivity-linked bonus. The amount so calculated may be paid by Department where he was working on 31s' March, 2018 and/or at the time of payment.
(l) Part-time employees engaged on nominal fixed payment(l) Not eligible.
2. Whether ad-hoc bonus is payable to casual labour for an accounting year in the following cases:-
(a) Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year.(a) The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus. ex-gratia or incentive payment has not been earned and received.
(b) Casual labour who were not in work on 31st March, 2018 .The condition of being in on 31st March, 2018 employment as laid down in these orders is applicable to regular Government Employees and not to casual labour.
(c) Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year.If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2018 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.

Ref : Minutes of the meeting of the Standing Committee of the National Council (JCM) held on 25th October 2016 under the Chairmanship of Secretary.

Dear Madam,

In the Standing Committee meeting held on 25/10/2016 the following decision was taken on the above Agenda item :

"Staff Side reiterated that pending, decision on PRIS and PRP as recommended by both 6th and 7th CPC, the existing Cabinet approved formula should be in operation. Hence the reduction of one day's PLB in the Department of Defence Production and EME under MOD is not Justified. So the unpaid PLB should be given back to the employees to avoid any litigation on the subject. Secretary (P) desired that JS (Pers) may re-examine the matter"

It is now almost 2 years after above decision taken in the Standing Committee meeting. However no instructions has been issued by the Department of Expenditure to pay back the PLB days deducted to the employees of Department of Defence Production (OFB, DGQ and DGAQA) and EME of MOD. Since the affected employees are pressing hard it is request that you may kindly arrange to issue necessary instruction in this regard.

2. Accordingly, the competent authority is pleased to convey the approval for payment of the Productivity Linked Bonus for the year 2016-2017 for 60 (Sixty) days in all the offices of EPFO. The bonus of 60 days has been assessed on the basis of data/information submitted by the Regional Offices in compliance to Head Office letter dated 21.08.2017. The payment of bonus is to be released to all Group 'C' and Group 'B' (Non-Gazetted) employees of EPFO.

3. The terms and conditions governing payment of P.L.B. will be as per the instructions issued by the Government of India for payment of the bonus to the employees in Central Government departments from time to time. However, the quantum of bonus may be assessed as per the following formula circulated vide Govt. of India, Ministry of Finance O.M. No. 7/4/2014/E.III(A) dated 19.09.2017.

4. Further, Ministry of Finance vide O.M. No. 7/4/2014-E-IIIA dated 29.08.2016 has revised the calculation ceiling of monthly emoluments for the purpose of payment of P.L. Bonus from Rs. 3500 to Rs. 7000 revised w.e.f. 01.04.2014.

5. The term 'emoluments' occurring in these orders will include Basic Pay, Personal Pay, Special Pay, Deputation (Duty) Allowance and Dearness Allowance, but will not include other Allowances, such as HRA, CCA Special Compensatory (Remote locality) Allowance, Bad Climate Allowance, Children Education Allowance and Interim Relief etc.

6. The expenditure incurred for payment of bonus may be debited from the budget head "Productivity Linked Bonus."

It has also been decided that in the case of eligible employees mentioned in Para l above who were not placed under suspension, or had not quit service/retired/expired during the financial year 2016-17 or were on leave where leave salary admissible is not less than that admissible on leave on average pay, may be paid an amount of Rs.17,9511- towards Productivity Linked Bonus for the financial year 2016-17. In the case of employees other than those mentioned above, the amount of Productivity Linked Bonus may be calculated in accordance with the extant instructions on the subject.

4. Further, in relaxation to the provisions in Rules 905(2), 908 and 909 of State Railway Provident Fund Rules, as contained in Chapter 9 of R-1/1985 edition (2003 Reprint edition), such of the subscribers to the SRPF as are entitled to Productivity Linked Bonus may, if they so desire, deposit the whole or part of the amount admissible under the Scheme in their respective State Railway Provident Fund Accounts.

5. Disbursement of Productivity Linked Bonus for the financial year 2016-17 to all eligible non-gazetted Railway employees mentioned in Para 1 above should be made on priority in the same mode as payment of salary before the ensuing Puja/Dussehra holidays.

6. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has given its approval to pay Productivity Linked Bonus (PLB) equivalent to 78 days wages to eligible non-gazetted railway employees (excluding RPF/RPSF personnel) for the financial year 2016-17. About 12.30 lakh non-gazetted Railway employees are likely to benefit from the decision. This payment will be made before Dussehra/Puja holidays, bringing a smile to lakhs of families ahead of the festive season.

The payment of PLB would serve as an incentive, and result in motivating a large number of Railway employees, particularly those involved in execution and operations of railways, to improve their productivity and ensure safety, speed and service for Railway customers. Indian Railways operates on the principle of maximum public welfare, and in this context, this bonus payment will help in improving accountability and efficiency in railways operations.

The financial implication of payment of 78 days' PLB to railway employees has been estimated to be Rs. 2,245.45 crores. The wage calculation ceiling prescribed for payment of PLB is Rs. 7,000/- p.m. The maximum amount payable per eligible railway employee is Rs. 17,951 for 78 days.

Sir,
It is to bring to your kind notice that Productivity linked bonus is required to be paid before Durga Puja. It is therefore requested to kindly cause action for making payment of bonus before Durga Puja.
It is also worth mentioning that an arbitrary cap of 60 days has been fixed for payment of PLB.
Now the business and revenue of Department is increasing every year.
Therefore kindly take necessary action to remove this cap and arrange to make payment of bonus which comes out real.

Please refer to our discussion held in the chamber of AM(Staff), Railway Board, on the above subject matter on 4th August, 2017. All India Railwaymen's Federation(AIRF) has already explained in detail its viewpoint in respect of calculation formula for payment of PLB to Railwaymen.

You may recall that, PLB has been an outcome of the bilateral agreement between Ministry of Railways and Staff Side Federations, which was arrived at on 22.11.1979. The formula for calculation of PLB, that was formulated as a result of above-mentioned agreement, is sacrosanct, on the basis of which payment of PLB is being made to entitled railway employees every year till last financial year.

AIRF is totally against any deviation in the well settled formula devised to calculate PLB payable to railway employees under the said agreement.

It is, therefore, urged that, payment of PLB for financial year 2016-17 should be made on the basis of established formula as mentioned above and there should not be any effort to make any amendment in the same as also number of days, calculated last year for payment of PLB, should not be reduced, else this will lead to unwarranted impairment in industrial peace.

Subject: Productivity Linked Bonus for the civilians of the Indian Navy for the year 2015-2016.

Sir,
I am directed to refer to the Productivity Linked Bonus Scheme already circulated vide this Ministry’s letter No.F.24(9)/80/D(JCM) dated 28th September, 1983, as amended from time to time and to convey the sanction of President to the payment of 40 days (forty days) wages in cash as PLB for the year 2015-2016 to the eligible civilian employees of the Indian Navy.

2. The entitlement has been worked out on the basis of the working results for the year 2015-2016 in accordance with the agreed formula.

3. The PLB shall be paid to all eligible Gp. B (Non-Gazetted), Gp. C and Gp. D civilian employees of Indian Navy who are covered under PLB Scheme for the accounting year 2015-2016. The calculation ceiling of Rs.7000/-(7000×40/30.4) and other terms and conditions of the PLB Scheme will remain unchanged.

4. Productivity Linked Bonus to the casual labourer will be paid at the assumed wages of Rs. 1200/- p.m.(1200×40/30.4) for the accounting year 2015-2016. However, in Cases where the actual wages fall below Rs. 1200/- p.m., the amount will be calculated On the actual monthly wages. The other conditions remain unchanged.

5. The expenditure on this account will be debitable to Defence Services Estimates under respective Heads to which the pay and allowances of these employees are debited. The entire expenditure on the payment of PLB is to be met out of the sanctioned budget grant for the year 2016-2017.

6. This issues with the concurrence of the Ministry of Finance (Dept of Expenditure) vide their I.D. No.30030832/E-III(A)/2016 dated 05.10.2016 and MoD (Fin/AG/PB) vide their Dy.No.187/AG/PB dated 5.10.2016.

The Government of India, Ministry of Finance issued order on revised ceiling limit of PLB from Rs.3500- to Rs.7000- from the year 2014-15 (OM No. 7/4/2014-E-III A dated 29-08-2016) to all Central Govt. Employees. It is apparent to note that the calculation of Productivity Linked Bonus for the year 2014-15 with revised ceiling limit @ Rs.7000-to regular departmental employees in the Department of Posts has been granted vide letter No. .26-01/2015-PAP dated 02-09-2016 and the arrears have also been drawn in favour of the regular employees.

The case of 3 lakh GDS employees regarding applicability of revised ceiling limit @Rs.7000- is yet to be finalized by the Department.

Therefore, it is requested to kindly expedite the grant of Bonus to 3 lakh Gramin Dak Sevaks at the revised ceiling @ Rs.7000- from 2014-15 prospectively.

Early action is highly solicited.
