CITU Congratulates the Gramin Dak Sevaks for the magnificent united all India strike

Demands the Government immediately implement the pro employee recommendations of Kamalesh Chandra Committee Report

Centre of Indian Trade Unions (CITU) congratulates the nearly three lakh Gramin Dak Sevaks (GDS) of the Postal Department for the magnificent united all India Strike. All the four GDS Unions (AIPEU-GDS, AIGDSU, NUGDS & BPEDU) are on an indefinite strike from 22 May 2018. All the postal employees’ unions have supported the strike. As per reports the strike is total and 1,29,500 Branch Post Offices remained closed.

More than 60% of the employees of the Postal Department are GDS and more than 80% of the Post Offices are GDS Branch Post Offices. Major revenue of the department comes from GDS. They are not treated as Postal employees and were paid a pittance. The Gramin Dak Sevaks have a great legacy of struggles and whatever facilities they are enjoying at present is the result of their bitter struggles along with the postal employees.

This strike was forced by the NDA government which not only denied to address the long pending demands of the Gramin Dak Sevaks for regularisation as government employees, but refused to implement the recommendations of Kamalesh Chandra Committee Report on the service conditions of the GDS. The Committee which was appointed by the government to look into the service conditions of the Gramin Dak Sevaks had submitted its report as early in November 2016. The Union Minister had promised to implement the pro-employee recommendations of the report. Even after eighteen months the orders are still awaited. The GDS and their unions were forced to go on an indefinite strike after the government had failed to meet even the latest deadline of April 2018, it had promised.

CITU expresses solidarity with the striking employees and demands that the NDA government must immediately settle the issue by agreeing to the just demands of these grass root level workers who deliver valuable service to the common people.

In terms of Board's letter 21.09.1982 and 28.08.1997, the facility of Special Casual Leave and Special Passes were granted to the office bearers of All India scheduled castes and scheduled Tribes Railway Employees Association (AISCSTREA) and all India OBC Railway Employees Federation/Association (AIOBCREF/A) as and when they are required to attend the Informal meetings at the zonal Railways /Railway Board’s level.

2. However, one of the railway has sought clarification on special Casual Leave to be granted to office bearers of the recognized welfare associations viz. AISCSTREA and AIOBCREF/A for attending the Informal Meeting called for by the Railway Board/Zonal or divisional railway administration.

3. The matter has been examined and it has now been decided that 2 days special casual leave should be granted )one day for informal meeting and one day prior for their internal meeting) plus the journey time to the office bearers of all India scheduled castes and scheduled Tribes Railway Employees Association and All India OBC Railway Employees Federation/Association for attending the Informal Meeting as and when called for by the Administration at Railway Board/Zonal/Divisional level.

This has the approval of Competent Authority.

Sub : Admissibility of Free Sea Passage to Service Personnel

The case regard admissibility of free sea passage to service personnel at A&N islands was referred to MOD for Clarification. The MOD vide ID Note No.10(8)/2014-D(Mov) dt.22.4.2016 and 7.3.2018 has clarified the LTC/Concession entitlement of the service personnel posted at A & N group of Islands as under:

Service Personnel posted in A &N Islands are entitled for the following LTC/concessions as per various orders:
i. Normal LTC under provisions of Rue 177(A/B) and 184 of Travel Regulations.

ii. In addition they are entitled to one additional free passage including sea passage to their SPR/Hometown in terms of GoI MOD letter No.5(30/07/D(Mov)dt.28th April 2010. This has been incorporated under Rule 177© of Travel regulations (2014 edition)

iii. As per GoI MoD letter No.67669/AC/PS 3(a) /1613 /D(Pay/Services) dated 13th March 1973 service personnel and their families are entitled free sea passage appropriate class once a year to Kolkatta/Chennai & back in addition to LTC
LTC/concessions / Sea Passage claims of service personnel posted at A &N group of Islands may be dealt with accordingly.

The undersigned is directed to refer to this Ministry's letter No. 17(02)/2016/D (Pen/Pol) dated 4th September, 2017. In accordance with Para 4.1.1 of said letter, the emoluments reckoned for calculation of pension include Non Practicing Allowance (NPA) granted to Medical officers of Army Medical Corps /Army Dental Corps / Remount & Veterinary Corps.

2. For Medical Officers of Armed Forces who have retired from 1.12016 to 30.6.2017, their pension is based on emoluments which included NPA @ 25% of the pre-revised pay. Orders have been issued by Ministry of Defence vide letter No. 4(10)/2017/D(Med) dated 28th September,2017 for grant of NPA to serving medical officers @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the medical officers retired/retiring on or after 1.7.2017 are entitled to pension based on emoluments which include NPA at the rate of 20% of the revised basic pay.

3. The matter regarding revision of pension the Medical Officers of Armed Forces who retired during 1.12016 to 30.6.2017 based on revised rate of NPA has been examined by the Government. It has been decided that all kind of pension/family pension in respect of Medical officers of Armed Forces who retired/died during 1.12016 to 30.6.2017 and were drawing NPA at old rates on the date of retirement/death, shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the basic pay on the date of retirement. The fixation of pension/ family pension of retired Medical officers of AMC/ADC/RVC in the above manner, shall be further subject to the condition that emoluments (i.e. Basic Pay MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand and five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.

4. This issues with the concurrence of Ministry of Defence (F1nance/Pension) vide their ID No. 10(8)/2018/Fin.Pen dated 11.05.2018.

During NFIR's PNM meeting held with the Railway Board on 13/l4-11-2017, Federation raised the issue of the condition of Railway Quarters outside agenda and stated that the condition of quarters continue to remain deplorable. Federation further said that the deteriorated condition of Railway quarters and the Railway colonies is on account of non-allotment of adequate funds and non-availability of artisan and other support staff under the JEs/SSEs (Works). Federation also stated that the deterioration of conditions has been causing severe hardships to the staff and their families living in the quarters.

Railway Board during NFIR's PNM meeting held on 10/11-5-2018 conveyed following position through Action Taken Statement delivered to the Federation in the meeting:-

"Railway is carrying out repairs and maintenance of quarters along with constructions of new quarters on regular basis and this is ongoing process. Efforts are being made to repair more number of quarters each year with more fund allocation under demand No. 11 (500). For repair and maintenance of residential buildings, Rs. 1790 Cr. (RE) were allotted in year 2017-18 under Demand No. 11 (500). In the year 2018-19, this amount has been increased to Rs. 1899 crores. A Committee was constituted on comprehensive Housing Policy to examine, inter-alia, upkeep and maintenance of colonies as well. The Committee submitted its report on 3110112018. Based on the recommendation of Committee, Board inter-alia has approved the following for implementation in phased
manner:-

(i) For upkeep and maintenance of Railway colonies, setting up of IT based call centres at location of maintenance redressal.

(ii) Setting up of a separate wing for maintenance of infrastructure not related directly with operations. Delhi Division is to undertake this project on pilot basis.

(iii) Fixing of periodicity and scale/schedule of Renovation and maintenance in line with CPWD (CPWD Portal) and practices.

(iv) Specification of Fixtures and Replacement items also need to be in line with CPWD Practice.

(v) Expenditure in PU 32 is to be maximized to 85%. Further PU 32 is to be splitted as under:-

a. PU32A for Type I & II.
b. PU32B for Type III and IV and
c. PU32C for Type V and above houses.

Instructions in this regard have been issued to all Zonal Railways.

Further, as per the full Board's decision taken in the meeting held on 05/10/2017 on maintenance of service buildings and colonies, all Zonal Railways have been asked to adopt user compliance for satisfactory completion of works in service buildings and colonies and to outsource maintenance work for selected colonies.

It may be seen from the above that substantial efforts are being made by Railways to improve the maintenance of Railway colonies and in the years to come the outcome of these steps will be visible".

Above position is conveyed to the affiliates for offering views to the Federation soon,taking into account ground reality and holding discussions with the concerned staff and authorities.

A delegation of Bharatiya Mazdoor Sangh (BMS), represented by its Pratiraksha (Industrial) unit called on the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh here today and discussed wide range of issues related to Central Government employees, including Insurance, Pension, promotions and other matters.

In a memorandum presented to the Minister, the delegation submitted that the Central Government Employees Group Insurance Scheme was notified on 1st November 1980 and came into effect from 1st January 1982. The scheme is intended to provide Central Government employees, at a low cost, on a wholly contributory and self-financing basis, the twin benefits of an insurance cover to their families in the event of death in service and a lump-sum payment to augment their financial sources on retirement. However, the BMS demands that the government should immediately notify the customized Group Insurance Scheme for Central Government employees with low premium and high risk cover.

The memorandum also expressed discontentment of a section of employees for being left out from the provision of minimum guaranteed pension under National Pension Scheme (NPS). It requested that a minimum pension be guaranteed equivalent to 50% of the employee's last drawn Basic Pay plus Dearness Relief for neutralization of price rise.

Among other issues raised by the delegation was the demand for one-time relaxation for compassionate appointments. This has become important because a large number of wards are waiting for their appointment on compassionate grounds to look after their family.
The delegation also demanded the framing of an appropriate transfer policy in all cadres in favour of single woman/single mother employees. They requested that whenever such women are given postings, it should be mandatorily ensured that they are placed at stations closest to their hometown or the place of their choice.

Dr Jitendra Singh said that he will direct the DoPT to process the issues related to them, while other issues related to other Ministries will be referred for the perusal and views of the respective Ministries.

Federation is thankful to the Railway Board for issuing instructions vide letter No. 2017/Trans/01/Policy/Pt. I dated 12/04/2018 to revise the remuneration of Para-Medical Staff on contracts basis working in the Railway Health Units/Hospitals on Indian Railways.

Federation however feels that the Para-Medical Staff, working on contract basis deserve to be granted following facilities which are presently denied to them:-
  • No TA/DA is paid to these staff when they are sent on duty to other places,
  • No Provident Fund is deducted from their monthly remuneration and credited to respective EPFO,
  • These staff are not granted the facility of Pass/PTo, Medical, accommodation etc., though they have been performing duties similar to the regular Para-Medical Railway Staff. They are also not provided periodic rest other than Sunday while they have been performing duties of 12 hours in a day.
Federation also contends that the Para-Medical Staff working on contract basis are entitled for above facilities in terms of the extant provisions of Contract Labour R&A Act, 1970.

NFIR, therefor, requests the Railway Board to kindly consider above points and issue instructions to the GMs of Zonal Railways to grant facilities to the Para-Medical Staff working on contract basis and mitigate their hardships.

A copy of instructions issued may also be endorsed to the Federation.

This is in supersession of all orders issued earlier on this subject.

2. Board has revisited the issue of complete separation of Traction and Coaching verticals at divisional level and decided the following.
a) The cadre control of Non-Gazetted staff diesel maintenance and operations would be under MTR and the cadre control of Non-Gazetted staff of MEMU/EMU/TL/AC would be under MRS.
b) The Administrative control of the officers manning diesel maintenance and operations would be with MTR and the administrative control of the officers of electrical coaching, including MEMU/EMU, TL/AC etc. would be under MRS.
c) Cadre control of Electrical Divisions, if there is a separate Sr.DME/DME for O&F wing, he would continue to look after the power wing till a Sr.DEE/DEE (OP/TRO) is posted and technically report to PCEE. If there is only one Sr.DME looking after both C&W and Operations, then diesel operations shall be placed under DME/AME and kept under administrative control of Sr.DEE/DEE of the division and the Sr.DME would look after Breakdown and C&W and would continue to report to PCME..
e) In Divisions, where the post of Sr.DEE/DEE (OP/TRO) is available, work of Diesel operations shall be transferred to Sr.DEE/DEE (OP/TRO) and the post of Sr.DME/DME (Power/O&F) would be re-designated as Sr.DME/DME (Freight) or Sr.DME/DME (EnHM) or as considered necessary in the mechanical cadre by the General Manager.
f) In electrified Divisions where the post of Sr.DME/DME (Power) and Sr.DME/DME(Freight) are both available, the post of Sr.DME/DME(Power/O&F) can be used as Sr.DME/DME (EnHM) or as considered necessary in the mechanical cadre…
g) In all divisions, the entire paraphernalia of TL & AC be placed under one DEE/AEE who would report to Sr.DME/C&W. On similar analogy one post of DME or AME (Power) along with the running staff looking after operation would report to the Sr.DEE looking after operations. while dual reporting should generally be avoided, however concerned DRM’s shall take a final call in the overall administrative interest whenever there is only one DEE/AEE or DME/AME.
h) The ministerial staff under Sr.DME/DME Power would be suitably redistributed by the DRM between the Sr.DEE (OP/TRO) and Sr.DME(EnHM) or Freight or as the case may be.
i) The same strategy as at 2(e) above shall be followed in non-electrified Divisions once Sr.DEE(OP/TRO) is posted.
3. The breakdown staff is generally provided by C&W and in few cases by Diesel sheds. While this arrangement shall continue and can be streamlined subsequently, the work of breakdown/accident relief should be assigned by the DRM's normally to a Sr.DME from the coaching side while implementing this order. PCME shall also continue to remain the technical head for breakdown/accident relief works.

5. The implementation of the above all over IR be completed in the next 15 days. Any minor issues that emerge subsequently should be sorted out at the level of GM’s without making any reference to Board.

A point has been scheduled to be raised in the forthcoming 23rd Ordinary Meeting of OFB JCM-III Level regarding affixing of Revenue Stamp on bills etc. It is alleged that some factories are insisting to affix Revenue stamp on bills above Rs 5000/- on or bills above Rs 25000/- while making payments through banks. In this connection please find enclosed herewith this office letter bearing No Pay Tech-I/0195 dated 8/12/2011 wherein detailed guidelines have been elaborated. It is, therefore, advised to follow scrupulously the guidelines laid down therein to avoid unnecessary confusion/ doubt while making payments made through ECS.

With reference to above cited letter please refer to Exception below Rule 92(1) of Swamy's Compilation of Central Government Account, Receipts and Payments Rules which states- "In case of payment credited directly to the bank account of the officers/staff the acknowledgement of the bank branches for the cheque sent to them is to be watched by the Drawing and Disbursing Officers and confirmation made to Pay and Accounts Office. No formal quittance is to be obtained from the bank or officers/staff". As such stamped receipt may not be insisted upon if payment is made through ECS.

The undersigned is directed to refer to this Department's O.M. of even No dated 26th September, 2017 regarding revision of the rate of Dearness Allowance w.e.f 01.07.2017 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 6th Central Pay Commission.

2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing 139% to 142% w.e.f. 01.01.2018.

3. The provisions contained in paras 3. 4 and 5 of this Ministry's 0.M.No.1(3)/2008-E.11(5) dated 29th August: 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

4. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.

Subject: Revision of Provisional pension sanctioned under Rule 69 of the CCS (Pension) Rules, 1972.

Sir,

I am directed to refer to the Department of Pension and Pensioner Welfare's OM No. 38/49/16-P&PW(A) dated 12th February, 2018 (copy enclosed) regarding "Revision of Provisional pension".

2. The applicability of the provisions of the aforesaid OM regarding grant of Provisional Pension sanctioned under Rule 69 of the CCS(Pension) Rules, 1972 has been considered by this Department and it has been decided to make the provisions of the aforesaid Office Memorandum of Department of Pension and. Pensioner Welfare regarding "Revision of Provisional Pension" applicable mutatis-mutandis, to the All India Service Pensioners to whom provisional pension was sanctioned under Rule 6 of All India Service(Death-Cum Retirement-Benefits) Rules, 1958.

Sub:- Revision of provisional pension sanctioned tinder Rule 69 of the CCS (Pension) Rules, 1972

The undersigned is directed to say that in implementation of the decision taken on the recommendations of the 7th CPC, orders were issued vide this Departments' OM No. 38/37/2016- P&PW(A)(ii) dated 04.08.2016 for revision of pension of pre-2016 pensioners/family pensioners w.e.f 01.01.2016 by multiplying the pre-revised pension/family pension by a factor of 2.57. Subsequently, vide OM No: 38/37/20 I6- P&PW(A) dated 12.05,2017, it has been decided that the pension/family pension of all Central civil pensioners/Family pensioners, who retired/dial prior to 01.01.2016, may be revised w.e.f. 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7 th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died.

2. Instructions were issued vide this Department's OM of even number dated 30.11.2016 for extending the benefit of OM dated 4.8.2016 to the following categories of pensioners drawing provisional pension under Rule-69 of the CCS (Pension) Rules, 1972,
(i) Retired before 1,1.2016 and sanctioned provisional pension under Rule-69 of the CCS (Pension) Rules on account of departmental/judicial proceedings or suspension.

(ii) Suspended before 1,1.2016 and sanctioned provisional pension, based on their pre-revised pay under Rule-69 of the CCS (Pension) Rules on retirement on or after 1.1.2016.
3. It has now been decided that provisional pension sanctioned in the above cases may be revised w.e,f. 1,1.2016 in accordance with the instructions contained in this Department’s OM No.38/37/2016-P&PW(A) dated 12th May, 2017. Higher of the two formulations i.e. OM dated 4.8.2016 or OM dated 12.5.2017 would he the revised provisional pension 1.1.2016 in such  cases.

4. This issues with the approval of Department of Expenditure. Ministry of finance ID N0.1 (21)/E-V/2016 dated 15,01.2018.

Office Memorandum

Subject: Review of the Recruitment Rules/Service Rules (RRs/SRs) - reg.

DOPT vide OM AB-14017/14/2018-Estt.(RR) dated 31.12.2010 issued instructions laying down guidelines for framing/ amendment/relaxation of Recruitment Rules. Para 3.1.5 Of the guidelines provide that the recruitment/ rules should be reviewed once in 5 years with a view effecting such change as are necessary to bring them in conformity with the changed position, including additions to or reductions in the strength of the lower and higher-level posts. Subsequently, this Division vide OM No. AB-14017/61/2008-Estt.(RR) dated 25.03.2014 re-iterated these instructions.

2. However, it has come to the notice of this Department that many Ministries/Departments are not undertaking the aforesaid exercise as stipulated. Resultantly, recruitment/promotion of officers/ employees are continued to be made on the basis of RRs which are not updated and continued to reflect old positions. It is a matter of concern that the decisions taken by the Government on the basis of pay Commission Recommendations, Court directions, Expert Committee Recommendations etc remain un-reflected in the relevant RRs/SRs

3. Since RRs are statutory in nature and all promotions/appointments are made as the provisions in the RRs/SRs, it is imperative that the RRs/SRs are updated in accordance with DoP&T instructions issued from time to lime. In view of this, Ministries/Departments are impressed upon to immediately undertake the exercise for review Of existing RRs/SRs which have not been amended in the last five years and intimate this Department about the outcome of the exercise so undertaken.

Sub: Clarification regarding entitled number of sets of "Post Retirement Complimentary Passes" (PRCP) admissible to lateral entrants in Railways Service.
Ref: (i) Board's letter No.E(W)2006/PS5-1/28 dated 18.04.2007.
(ii) Board's letter No.E(W)2006/PS5-1/28 dated 08.05.2008.
(iii) Board's letter No.E(W)2013/PS5-1/7 dated 16.12.2013.
(iv) Board's letter No.E(W)2013/PS5-1/28 dated 12.03.2014.

In the PNM/NFIR meeting with Board, the Federation have raised an issue that lateral entrants in Railways Service, especially ex-servicemen, who have retired or ceased to be a railway servant, after having rendered more than 20 years of qualifying service (i.e. after addition of admissible past non-railway service) are not being issued entitled number of PRCPs.

2. In this context, your attention is drawn to the amendment made vide Advance Correction Slip (ACS) No.53 to Railway Servants (Pass) Rules, 1986 (Second Edition - 1993), circulated vide Board's letter cited under Ref.(i) which provided for giving weightage only to the extent of half of the period of past non-railway service rendered by "Ex-servicemen or Central Government employees" for determining their eligibility to PRCP. The said provision was further amended vide ACS No.56, circulated vide Board's letter cited under Ref.(ii). It provided for counting of half of the period of past non-railway service rendered by the lateral entrants in non-railway departments or establishments to determine their eligibility ot PRCP subject to the condition that the said period of past non-railway service has been counted along with the railway service for pensionary benefits. It was also made clear that the number of PRCPs of such lateral entrants shall be at par with those railway servants who have retired with minimum 20 years of qualifying railway service.

3. Furthermore, in terms of ACS No. 74, circulated vide Board's letter cited under Ref.(iii), read with Board's letter cited under Ref.(iv), railway employees who retired on or after 01.01.2006 were made entitled to the following PRCP facility:-

4. Accordingly, it is clarified that the lateral entrants who have retired or ceased to be a railway servant w.e.f. 01.01.2006 after having rendered 20 years or more of qualifying service (i.e. either railway service plus half of the period of past non- railway service counted along with railway service for pensionary benefits or railway service exclusively), are entitled to the number of PRCPs as stipulated in preceding para 3.

5. The Railways are advised to follow the extant provisions of statutory rules scrupulously and issue passes accordingly.
